:mad: :mad: :mad: Hi, first post and apologies , it is going to be a bit of a rant!!
I remember that someone here did a post about an offer Talkworldonline were doing for a free psp and also 1/2 price line rental.
I duly signed up for this deal, got my confirmation email on the 30th Dec. By the 4th Jan no delivery, so called to check, said it was going out that day. Wicked. Recieved phone on the 5th, and generally happy.
Check Paperwork last Friday and see that they have sent 2 contracdictory pieces, one refers to 10 months free line rental but no redemption certificate, redemption certificate for the free PSP.
Been trying to get through since them to get the correct paperwork, so call today and get told that it was a mistake on the website, only meant to be free PSP.
So I say "I wasn't informed of this, didn't the contract complete when I recieved teh goods and surely they can't change it now?"
She says I can send the phone back , which is to thier advantage as I believe that they should honour the original offer as I was NOT contacted either by telephone or email , on any difference.
What options do I have ?? Small Claims court, push the issue of contract with them ?

Depends on what paperwork / proof of the deal you have. If the acceptance email from them clearly stated the half-price line rental and free PSP then go for it...
Send them a letter enclosing a copy of the email (or other proof of offer taken) giving them 14 days to either provide you with the PSP or the means to do so. State that failure to do so will result in you buying the PSP elsewhere and suing them for the cost. Include details of the cost of the PSP from elsewhere. Send it recorded delivery.
If no satisfactory reply received within 14 days (plus a couple to allow for posting), then start a claim using Money Claim online. Chances are they'll let it get this far then pay out - as the defendant vs a company you can have the court hearing nearest you so it's cheaper for them to pay you rather than attend court.0 -
Thanks for your reply, I have sent the following email to someone superior @ Talkworld, I honestly believe that they are choosing not to honour it as there may have been too large a response, I have original and scanned copies of all the emails and documentation and am awaiting a repsonse , Fingers Crossed they will just honour it. The funny thing was the girl I spoke to today, was SO eager for me to send back the phone today, which I responded to that I am at work and can't. I think that they know they can't really get away with it, she seemed anxious LOL, though It's like ordering a car and getting one delivered without the wheels, no one would stand for that !!!
DETAILS OF EMAIL:
Hi Paul,
I am writing with regards to the above offer that was available under the London Offers section of your website on the 30th December 2005.
The offer was:
A Free Sony Ericsson K750i on Orange with 300 minutes per month
A free White Sony PSP
Free 10 months half price line rental.
I duly signed up for this deal and was sent an email confirmation at 5pm on 30th December 2005.
By 4th January there was no delivery, so I called your customer services, which took my reference number and ONLY told me the phone would be delivered the next day.
Received the phone and everything on the 5th January, generally happy with the phone.
On Friday 13th January I am going through my paperwork and realise that there is contradictory information, within the papers I have been sent. I have a letter by Sitansh Shah referring to my 10 months Cash back, however I cannot find a redemption certificate. On the other hand I also have a certificate referring to the free white PSP.
Realising there has been a error with the attached paperwork, I contact your team today. Someone answers, I explain the errors in documentation, then I am put on hold for 5 minutes, she returns and then tells me that “Sorry Miss Onap, there was an error on the website and this offer only involves a Free PSP” so I reply
“I haven’t been informed of this, and I have contradictory paperwork”. I am put on hold again, and she comes back and says “you can return the handset if you want”.
I inform her that I wish to speak to someone superior. So I was given your email address.
I understand by reading your terms and conditions on the website that:
1. The offer on the website was merely an invitation for me to make an offer, which I duly did by filling in my details and placing an order on the 30th December 2005.
2. A confirmation email was sent from Talkworld on the 30th December 2005 detailing the offer, I accept that this did not constitute acceptance my offer on the 30th.
3. The goods were dispatched by Talkworld and I took delivery on the 5th January 2006, this I believe completes the contract.
At no point prior to the contact I Initiated with your online sales team today, was I told that there had been a mistake on the website and the offer only contained a Free PSP. Surely if the offer was going to be changed substantially, I should have had written confirmation via email, or at least a phone call initiated by one of your online sales team, you had all my contact details available.
Therefore I write to you to request that you honour the contract as it stands.
