    I'm not entirely sure why it went to court, I guess they had their reasons, but I decided to make the £85 weekly payment myself on about the 14th Nov, the letter I received from the HA was dated 25/26th Nov, so after...I guess due to my erratic previous payments, they felt they had no choice? Still, might adk for an adjornment and definately fight the costs. I can ill afford those on top of everything else going on.

    Depends how harsh the management team have asked them to be - eratic payments aren't good but if you have been making regular weekly payments and the arrears had been reducing then there is no real need to take court action. They haven't really left enough time between agreement and court action - unless payment hadn't been received for one or more of the dates.

    Let me clarify for myself, when you decided to make the payment of £85 from 14th Nov did you confirm this with HA that this was acceptable? I think you said you did but I'm getting confused! You didn't make a promise to pay anything else that wasn't paid?

    Essentially the HA want people in the properties who pay rent on time and in full. It's hard enough to recover rent arrears at the best of times but in the current climate.... Maybe the staff have been told to refer everything over a certain level to court to get a court order so that if further problems arise with non-payment then it is a quicker process to evict that tenant. It will more than likely have been authorised by a manager as well so there must have been reason.

  • Yeah I know, erratic payments are a nightmare, and they wasn't intentional. Nope, payment has been sent and received on each and every occasion I have mentioned, I decided to pay £85 a week on the 14th (ish), then I received a letter from them after this date, Ive just read it and at the bottom it says "please contact me with your proposals within the next 7 days", yet they didn't give me 7 days, because when I rang them, she said it'd already been referred to court, so that was a bit unfair!

    06 - 150
    14 - 100
    15 - 90
    20 - 85
    26 - 85
    30 - 350

    Arrears currently - £163. I have another payment of £85 to make on Friday (previously agreed), so the arrears will then be £146.05 :)

    I notice that a couple of your bills etc....are quarterly and yet you haven't put anything aside in January for these bills. This may be where you are going slightly off course. You need to put something aside now for them...You could set up a dd for them and get them cheaper or you could buy stamps for them....

    Adams - £131 - had a letter from them saying settled, but still says in default on credit fileWrite to the credit reference agency. Stating that you have this in writing saying settled.

    If on the 9th you put the things I've mentioned into savings along with what is left of your overtime. You will have £300 approx to put towards the car tax and insurance etc. I would recommend you only get 6 months tax this time. I know it is slightly dearer but it means it will run out in August and you won't have so much to find each February.
    At the end of January if you have anything left in your account move it into the savings. Then you will see exactly what you have available for the large bills that are due.
    So in January you will have no more rent arrears and can clear the court fine.
    Do you know if NEXT are adding interest to your debt. Or if any of them are.We will need to know so that you can prioritise which one to pay off first. Have you set up with payplan yet?
    I'm not sure if you can do this or not (someone else will say) but I would not tell payplan that you get overtime. Just fill in their soa with your normal weekly wage. Then if you save up all your overtime after the year you can go back to them and say I have an extra £XX what shall I do with it. They will then negotiate on your behalf again
  • Thanks everyone for helping with this. As far as the hearing goes, it is on Tuesday, and I'm getting more and more worried everyday. However, as my arrears are now £146 (payment of £85 made this morning in accordance with my agreement), I am a little less worried.
    All the advice you have given me is very much appreciated, with the hearing and also with how to manage my finances effectively.

  • Hi Guys :) Sorry I haven't been on since yesterday...have been sorting things out...anyway. Ok so on Monday I received an email from the HA, saying that due to my arrears being so low, she would be asking for an adjournment...that said, The hearing was at 10:30 yesterday, I arrived at the Court at 10:15, was standing around alone until 11:15, when the user called my name to go in and see the Judge. I went into his office/room and he said that the representative from the HA hadn't turned up and as my arrears were significantly lower than origianlly stated, he was going to adjourn the case. He said it would be struck out. As for the court fees, there was no mention, and I didn't like to ask! But I assume I am not liable for these. Am so very glad it's over now (i have £70 to pay, which will be done Friday), and I have learnt a very valuable lesson - NEVER put any debts above the rent/mortgage!

    I can't thank you all enough for the help and support you have given me over the past couple of weeks :)

    Just have to hope you'll all continue to offer advice when it comes to getting the rest of my finances in order!

    That is absolutely amazing news, I'm so plzed for you, I only guessing but as you turned up and the HA did not tturn up, I very very much doubt the judge will award the costs for you to pay.

    Look at this experience as a kick up the rear, it sounds daft but regardless of what people say or do, unless u have hit ur rock bottom then and only then can u pull urself up, I think this was the rock bottom point.

    If theres anything I can do just shout (very loudly) or pm, and if I can help I will.

    I know it may sound daft, but re-look at your SOA, aim it for 2 parts.

    Part 1 - Monthly total and expenditures, but with due by dates for each expenditure

    Example

    Rent 359 (5 WEEKS RENT) - pay every week
    gas 35 - in theory as and when
    elec 40 - in theory as and when
    haircuts 10 - money gets allocated, even if not used
    presents 15 - money gets allocated even if not needed
    council tax 34 - one payment a month - due by 12th jan
