Hi TotallyBroke, thanks for you last post, I had completely forgotten about the court costs. I would presume I am liable? They are £100 according to the documents I've had through at the moment. I have had my car out of the garage and now have £575 spare cash (well I say spare, if I don't put petrol in the car, which is empty, or buy food, then its spare!). Thats all the money I have available to me, and I won't get anymore until next Wednesday when tax credits are paid, and then the friday when I get paid. What would you suggest spending this on? All on the arrears....0

Got £575 now after car, in theory that has to last u to next wed (guessing thats 6th Jan, then you get money on the fri after the wed your wages.
(sorry thinking aloud, but method in my madness)
Can u remember / have you seen a programme called spendaholics on BBC, basicially people are in debt they come along and set new targets etc, but the main point is the 1st week of them involved they call it cold turkey week, where u live on the most mimum possible.......eg £40.00, so you use whats in the house, instead of haveing a lunch at work, take in sandwiches, downgrade ur shopping, eg Sainsburys (posh) to Netto / Lidl, only buy what you need.
Plan A - cover your bills that you know need to come out, (gas, elec etc and % towards other bills), then go for a cold turkey week, if you think u need £80.00 then thats a luxury, u only have £40.00, then pay the rest off your houseing arrears.
Re your wages, etc, how do you get pd, weekly, 4 weekly, monthly (12 or 13 payments), it sounds daft but by breaking it all down you find an extra couple pound here and there.
eg Child benefit, if you get paid 4 weekly, u actuallu have 13 payments a year, where u may of only accounted for 12 payments a year. xxx rip dad... we had our ups and downs but we’re always be family xx0 -

When Woolwich took me to court I was paying the normal amount plus half off the arrears. So £400 payment and £200 extra. When it went to court the Judge asked me how it was going. I said it was a struggle at times but I was lucky that my family would now help me if I needed it. His response was, "Well I don't know why we are here because you are keeping to the agreement. I therefore say that from the next payment you pay the monthly amount as contracted and pay £100 off the arrears" So I got a right result.
My advice to you would be to go armed with what the agreement is and show what you have been paying off the arrears. But don't commit yourself to anything too high. Tell them that if you did any overtime then you pay extra but that overtime is not always guaranteed. You also would not like to overstretch yourself and put yourself in the position of breaking the agreement.
As for the £575 I would keep the money to put towards your insurance etc. Pay it off in one go (it's cheaper than monthly installments) then from January put away the monthly amount that you have in your soa ready for next year.
I hope you see this before you go to court. Otherwise you will be robbing Peter to pay Paul in February when you have all your unexpected costs. You also need petrol and food so don't offer it all to them. If they want you to give them something extra this time then offer them £50-100 but no more.

Ps I never take people as being stroppy unless they make it very clear that's how they are behaving. None of your posts have come across that way.
PPs you may well be liable for the costs but the landlord has decided to take you to court so let him pay. If the Judge says you have to then you will have to pay. But drop a subtle thing in about "Oh well I do have an extra £100 to pay now because of overtime but if I have to pay costs I will have to use that money so arrears will be longer to pay off". Do not let them know you have £500 sitting around.0 -
Hi Mum2one - yeah I have seen that program, I've always wondered whether I should try something like that, I guess now is my chance!
I don't have any bills which need paying between now and the 9th (my next payday), so all I really need is money to live on between now and then, for food and petrol I guess
As for payday, I get paid every Friday (well I'm meant to, sometimes they come up with excuses and don't pay me, which helps!!), and Tax Credits, I get every 4 weekly, does this mean I have more money than I think? If so, that's even more worrying, because I've got no idea where it goes.
Do you think keeping some kind of money diary will help?

I wondered if anybody knew what was likely to happen in Court and whether the Court will grant possession back to the Landlord due to my erratic payments previously.
Please feel free to flame me, but my thoughts.
OP has a Court hearing where her social landlord will be seeking eviction for the non payment of rent,
If the Judge agrees, bailiffs will be instucted and OP will be evicted.
The Local Council will not be interested as OP has made herself intentionally homeless by not paying her rent.
End result could be that OP is housed in a hostel and her child taken into care.

Its unlikely that the court will grant possession as you have made an agreement & kept to it. The HA will be taking you to court to secure the agreement. You will probably get a court order to pay rent + X amount. If you dont keep to this order the HA CAN apply for eviction.

miss confused, no, if you do lose your case, and are put into a hostel, your daughter WILL NOT be taken from you!!!!!0 -
oh, and dont worry about legal representation, we hadnt even taken any legal advice, we got ourselves into the problem, and had to face the consequences, luckily the judge was understanding about our reasons0
