Seems like a reasonable defense given the time of year, but they really should have found someone who owned an Xbox and could have checked it was working, especially as it was a second hand game.

Basically, this is not your problem, they had it long enough and have passed the point where they can launch a dispute, so I would just send an apologetic email but state that it is no longer your problem and suggest that in future they should inspect purchases within a short time of receipt.

    Replied with this.

[FONT=arial,sans-serif]I have checked your feedback and can only see one xbox game that has been brought since your purchase from me in October.

As advised in my previous email i will not be refunding the item as it was working when i posted it to you over two months ago and feel it should have been tested upon receipt, if you had purchased this second hand from a retail store you would be past the timescale to return it and refund as well.

I will not be responding to any more emails regarding this item.

I would leave it now, there is very little point in continuing to correspond.

She's run out of options via ebay and paypal, whether she tries anything dodgy now is of course a risk..but hopefully she will realise her mistake and let it drop.

Strangely enough I have been back and forth to Tesco today to return and replace an item several times (queues queues queues). In front of me on one occasion was a youngish lad probably in his late teens arguing about changing a game from October that was bought as an early Christmas present. he was insisting he had a right to a refund as he had the receipt and Tesco were having none of it as he was outside their Christmas exchange period (apparently goods from 1st November can be exchanged) it also didn't help that game had been opened, lad claimed he opened it accidentally but didn't have the wii to play it on and wanted his money back. He wasn't getting anywhere there either so you are not alone in having people try the 'early Christmas present' line.

What do you mean when you say dodgy?

The item only sold for £10.51 plus P&P so not a major expense to her.

You get some wild wacky ebayers who do not know when to accept defeat and remind defiant to the bitter end.. despite not gaining anything at all by doing that.
