What can I do?!
Options
I bought a phone with o2 online.
I ordered it on the 14th December, but I actually started the contract on the 24th of December.
I had the first phone, and decided after a week or so that it needed replacing, as it was faulty. As it then took 5 working days for o2 to send me a replacement, I was then out of my first 14 days.
I have now had the 2nd handset for a week or so, and it's faulty aswell (constant freezing, missing calls, deleting messages, etc)
I've called up, but because I'm not within 14 days anymore, I can't send the phone back as faulty, and cancel the contract.
Is there anything I can do about this? Theres no point me having a replacement, as the phone will do the same again, and it's a top of the range phone, so there's nothing that they can offer which will replace it.
The guy on the phone was extremely rude, and told me that there was nothing I can do, and I have to see the contract out.
What are my rights, because surely a phone which isnt even 2 weeks old, locks up all the time, miss calls all the time, and when it freezes when I get a text message, and reset the phone, I lose the message, so i dont even know who sent it, isnt fit for purpose? Do I have rights to cancel the contract?
Any help MUCH appreciated, since the phone cost £150, and the contract is £25 per month, and I cant afford to keep this contract AND buy a new phone!

maybe try ringing again and speaking to someone else? They have to at least repair the phone as it would be under warranty0

my first thought was, and i stand to be corrected, don't accept a repair once you do you will not be able to reject it, instead go for the line manager option explain that with xmas post and so on you didn't use it , tell them you love O2 and don't want to cancel and see what they offer you. i have a similar ongoing with BT mobile but my problem is they have changed there airtime provider from T mobile to Vodap and everyone that lives in my area knows voda don't work they are arranging to cancel my contract and i am 5 weeks in, so even tho the phone don't work i can still praise BT.Div 1 Play Off Winners 2007
