My question is that can i get this deal, purchase the N70 from ebay, and use the Sim from this deal on my N70, obviously having sold the free phone on ebay? Woudl that work?

Is the N70 a 3G phone? Could possibly only do this if it is, however 3 aren't keen on people putting their sims in other phones and will possibly charge you for calls

Also wouldn't pay much more then £200 for your N70 as you could buy it for £240 via a cashback offer and claim some extra cashback through quidco too.

How would Three know that i am using another phone to make the calls?

Think it's something to do with using a 3G sim in a 2G phone switches the network to another one and 3 find out - someone with more experience in this area might post soon, but it's basically something like that.

the N70 is a 3g phone so would work with a '3' sim card
