Orange miss-sold data tariff unlimited

I've got a recent deal on my orange phone...

After recieving my diamond, I setup my work email to be pushed to the phone, and enjoyed the internet access.
I was unahppy to fid out, my bill had shot up from 35 quid, to 447.55!! It turns out, the "unlimited" internet access (capped at 250 meg) wasn't going to be applied until my next bill. I hadn't been awrae that the data bundle wasn't a data bundle, but part of the tarriff, or that the tarriff wouldn't kick in until the next month.
Annoyingly orange didn't inform me that my data usage was massively above average, or apply a daily cap, so I ended up paying on average over a tenner day for my internet usage!
Be careful when taking out a new deal!
What do you reckon my rights are regarding this? I've asked for a copy of the original sales call to find out if he did miss-sell me. If they can't find it, is it assumed that the customer is always right?

I had a similar thing happen, though thankfully for far smaller sums. Asked to change to a data inclusive package, they said sure all done, but three months later and five calls later I'm still paying per MB. If they don't offer me something amazing when my contract expires in 4 weeks then I'm on my bike.

I would think they will credit it back to you. As you had received the new phone it is reasonable to assume your new tariff had started too. o2 certainly has a 'first offence' limit where they will credit back the first time someone has used data excessively, and even more readily when we were supposed to apply it - I just seen a bill for £35,000 written off recently.

Are you serious??!?!? That's increadable. How did the get that bill, were they using their mobile as a server?

Email being pushed isnt always covered either. TMobile dont cover email push. I recently trialled a G1 with Tombile, they changed the tariff pro rata on the phone when I had accepted the new contract. Seems odd that O2 wouldnt have done the same.0

It was mobile broadband being used in Ireland.
And I don't see why a data bolt on wouldn't cover email push - if mines didn't I would be absolutely livid! But anyway like I said, give them a call, please don't mention the £35k, it was me who was involved in that so fingers would come straight back here!

Push email uses a heck of a lot of data. The phones checking the server every few seconds and even if there's nothing to find it still has to send the log in info which mounts up over a day (and night).
Most networks have a product for push which is added to your acc and give you access, usually, to the Rim server for the Blackberry for an all in charge.
Any change to your contract only happens on your next billing period, not right away.
The networks don't monitor your usage, they'd need 10 times the staff !0
