Can i ask a stuid question........

You know this 14 day rule that you have to get the letter within 14 or it's viod.....

Well my Quetion is if there is no signiture on delivery how can they prove that you got the ketter within 14 days???????
They don't have to, provided it was send by first class post in time for it to be delivered within 14 days. If you wish to challenge it, you have to do so on the basis of "rebuttal of service", for example if you could show that a significant percentage of your post goes missing, or gets delivered to the wrong address, that may work.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • Hi FeelinSkint,

In my experience with companies demanding some kind of money via the post, they do not need proof of receipt, only proof that they sent the letter. I had an issue with a Bank a few years ago who claimed to have sent me letters about a particular issue. I didn't receive them, and so protested, but they still charged me the extra monies incurred as a result of the letters not being received. Nasty Pasties!

I would assume that nothing has changed within the last few years and companies can still operate in this way... unfortunately.

EDIT: Oooops, sorry Bargepole I must have been posting at the same time you were! Didn't intentionally reply to the same post as you! Yours is more helpful anyway.... (at least mine backed you up???)

...but make sure you have thoroughly researched the price of flights before doing so!!!
