  • Just a quick question, can bailiffs remove goods without a Walking Posession Order having actually been signed (signed by the person who's goods are being seized)?

    In other words, if a bailiff gains entry to a property, can s/he then simply remove goods on a first visit without a signed WPO (if for instance, the 'debtor' disputes that the goods listed are actually theirs)?
    Sorry about bumping up my own question, but does anyone know the answer to this please? (It's still an issue, even several weeks later ...)

    A walking possession notice is one option that the bailiff has to force recovery of the full amount in cash as quickly as possible.(this is obviously much more preferential that actually removing goods immediately)

    In real terms all a walking possession notice is a very basic form of blackmail and terrorism, i.e pay me my money or I will take all your things !

    The last thing a bailiff actually wants to do is remove goods, as this far to much hassle for them, and they would much rather just have the cash and move on to the next victim.

    So in short, If the bailiff has not gained entry to your property then no he cannot issue a walking possession notice, and therefore there is nothing to sign.

    If he has gained peacefully entry at any time then I am afraid you will have little option but to sign the Walking possession notice if you want to keep the goods for an extended period.,

    If you refuse to sign the WP notice once peaceful entry has been gained then the bailiff will be within their rights to seize goods immediately as part of their execution of the original distress warrant

    With regards to ownership issues, you would be expected to prove ownership at the point of recovery / seizure.

    You need to go to the council tax office in person tomorrow and speak to an advisor. CT and rent are priority debts, has it gone to court yet? I think it has to go to court first, CT should make a new agreement with you, take a break down of income and expenditure and find out what you can actually afford, they have dif methods of taking money - deduction from earnings, straight from JSA/IS, or even set up a standing order., but don't leave it to your husband if he keeps forgetting.

    FAilure to pay CT can lead to imprisonment. Sorry not trying to scare you.

    GO IN PERSON AND SORT IT TOMORROW Time may be of essence,
    ps Def go to CAB and again ASAP as they don't see you immediately
