    This be great if the interest was stopped. The default I got from Nationwide stated that they would not charge interest for the first 28 days and after that at 16 %.

  • I have been successfully doing my DMP for 6 months. I have recently had a budget review from the CCCS. As a result my monthly payments to them will be lower as of next month. Can I expect a barrage of letters and phone calls from my creditors because of this as obviously the initial agreed payments will be slightly lower. Most of the letters from my creditors have said that the arrears have been wiped off but charges and interest will accrue if any more arrears appear. Whats the best thing i can do here.... :(
  • Well the NatWest saga rumbles on - got a letter yesterday saying they'd call off the collection process & accept the DMP if we sent them details by the 28th. BUT they didn't put an account reference on the letter so I have no idea if it is from the loan account (the one they've defaulted & have taken money from an empty current account (putting us into an unauthorised od)) that I've just sent an SAR for or for one of the cc accounts. Oh & they've written to us asking us to send them signatures for our cc accounts ... I don't think so :rolleyes: Might CCA them now.

    What was the interest rate prior to default? If it was lower than 16%, then they in breach of the CCA1974 section 93.

    does this apply if you were on a special balance transfer rate?

    Not sure on this!

    I think that most credit card companies have a clause in the terms and conditions of any special balance transfer rates, so that if you miss any payments whilst on the special rate, you automatically revert back to the standard rate.

    Been a while since I had chance to post on here! Been busy with competitions, surveys etc etc!

    DMP seems to be going OK, had my review a few weeks ago and increased what I pay to £293 a month, which having had a pay rise, will mean I'm paying £60 a month more than before! Had to reduce my payment this month by £100 though because our cat was ill and the insurance wouldn't pay out, so we had to find £750 to pay for his treatment and he died in the end anyway :( Still, somehow we managed it and a local charity we do work for paid some towards it too.

    Written a letter to MBNA today because they are still charging me, so my balance has increased since starting my DMP. Managed to claim £32 from Barclaycard from an ancient account a while back and I'm trying to claim from Capital One, when they eventually sent my statments!

    We have just begun a DMP with CCCS and CCCS have just sent offers out to all our creditors.

    RBS have refused CCCS offer under the basis they want more! Why doesn't that surprise me from that bank! RBS have also sent me a shirty letter stating they are going to default me and threatening legal action - they are my biggest creditor with two credit cards and a loan - total value in excess of £20,000!

    I have also received a letter from them in connection to me trying to reclaim my bank charges (over £1,500!) in which they wont consider it yet unless I can prove I am in financial hardship - are these people for real!

    Can I just give them CCCS number and reference or do I need to complete the Customer Financial Statement they have sent me?

    Anyone any answers please ??

  • Hi all,

    does anyone know if there is a number of times that a creditor is "allowed" to call you per day. Have read a few different things in which they have claimed that it is their right to contact you how they choose. Sky are currently calling between 8-10 times a day, every day, and it's doing my head in to put it mildly.:mad:

    I sent a "polite" request regarding written comms last week which hasn't helped so have just dashed off a harassment letter which I will send today. I have also written to them 3 times (by R/C) enclosing my I & E but have had no response at all - apart from the constant phone calls which I refuse to answer. Anyone have any info on Sky and how long it may take to get a response?

    Hi seasiders:

    With regard to the default notice threat, just think "bring on the default"!! RBS (Mint) didn't default me until 4 months into the DMP and when they did issue a default notice, all charges and interest stopped ;) They defaulted me over 18 months ago and I've had no legal action from them (but they never wrote to me to accept or refuse the dmp - the only letter I got from them was the default notice).

    As for reclaiming charges, sorry can't help, haven't done it. The only charges I had were when starting the DMP.
