Unsure About Incorrect Bank Payment

Hi
could some one help me here.
My partner has had a lump sum wrongly credited to his account by his bank.
However the amount was not credited by his branch but from another area.
They have sent him a letter asking for the money back, and he has to sign a form to allow them to do this
Does he legally have to give the money back, even though the bank had made the mistake in the first place?

Its not his money ...
He has to give it back....
if it went to court.. he would also have to pay court costs and explain to the judge why he did not pay the money back.0 -

You could put a note with the form asking the bank to make a payment to your partner by way of compensation for the time and money they have spentin dealing with the matter.God save the King!

you should get something in comp, egg example, what if you had not deposited because of the credit and when they whipped it out you went od, or spent what you was going to deposit because of there mistake and now when you repay don't have the cash to stay in the black, give it back but ask for something after all when you make a mistake they charge you enoughDiv 1 Play Off Winners 2007

Sorry but I'm on Stonk's side on this one.
Too many people today expect compensation for a genuine mistake for which they have suffered no loss. These very same people post drivel on here wanting companies to refund charges because they have forgotten to make a payment on time and it's always somebody else's fault.0 -
This money probably belongs to some, possibly not well off, 'individual' who simply pressed a wrong digit when doing an online banking transaction. He/she has then realised their mistake and taken it up with their bank.
The upshot is that their bank then contacts the OP's bank, who then contact the OP to ask for the money back - because the T&C's of the current account say that they cannot just simply take it - they must ask first.
The OP needs to consider, and understand, the extreme anxiety that the 'individual' must be going through. They may now be incurring additional costs because they haven't been able to pay their mortgage or credit card/loan repayments on time. The longer this goes on, the more fees and charges are being racked up and, as we have seen on the 'bank charges - illegal' thread, the final bill could be £100's of pounds.
And the OP says "do I have to sign the form?"
For your own sake, you'd better hope that the bank itself never makes a deposit in error to your account, because if you spend it (knowing it not to be yours) you could be in serious trouble - as detailed in, for example, the A&L current account T&C's, where they state they will take it without warning or asking you to sign a form...6. I understand this is like dangling a carrot under a donkeys nose and then asking the donkey not to eat it.
However in this case the carrot is bad and if the donkey eats it he will get ill.0 -
maybe if it happens to the OP one day, then that will make things clearer0
