The item was still sealed and not copied.
Im not upset that they wouldnt give me a refund it was only £35 I was mainly upset about there total lack of customer care with the rude and arrogant staff. Thing is my girlfirend brought the same cd off the net so I could have returned that one online we didnt because the staff told us that they would only issue a credit note/gift card too. Anyway as soon as the £35 is spent I will not be shopping there again.
Flog the gift card on Ebay! You'll get near enough £35 less a quid or so if you don't want to go back to HMV.0 -

The point is that the 'seal' is a good sign that the media hasn't been copied and therefore the policy for no refunds shouldn't apply in those circumstances as the goods can be resold as unopened and 'new'.
They may not be under any obligation, but It's just basic good customer service. As we all know presents can often get duplicated at Xmas.0 -
This has been in force at HMV for at least a year, as I was bought a duplicate CD (still sealed and stickered) for my birthday last December and was pretty shocked that I only got a gift card. Once I had spent the voucher I have not been into an HMV since. While I agree that the law says you are only entitled to store credit, they must be the only national media store to enforce this, and compared to others on the high street this is terrible customer service.
I usually buy from play.com now.

Just avoid HMV - if they think its good policy to annoy their customers then vote with your feet. Its always a bit disappointing when you find a big supplier isn't as good as you hoped.
I have never really liked HMV other than when the Phone Jacker rings them up!0 -
Doh! I bought my wife the new Take That cd online and it seems her mum has bought the same item so, according to HMV's website:

He wasn't lucky at all, he got exactly what he was entitled to. Whilst there is no automatic right for a refund or gift card in law, where there are signs up or a leaflet of terms and conditions available (as in all HMV stores) these terms make up a part of your contract. As soon as he had bought it he was entitled to return it within 28 days for a the value in gift vouchers/gift card credit. Simply because a right doesn't exist in statute doesn't mean you don't have these rights when they are a part of your contract with the store, and in my experience most stores have this policy as a minimum with many offering cash refunds. Absolutely nothing to do with luck.
To be fair to BD, I think that he was inferring that the OP was "lucky" because HMV have decided to apply T&C over and above their legal obligations.
I get a bit annoyed with shoppers getting on their high horse about !!!!py things like this.
You can't complain because somebody wouldn't do you a "favour". Anything that is over and above a legal obligation is a "brucey bonus". Take it as such.0 -

Perhaps, it's just something I've seen quite often on these boards "That's all you're entitled to" or "You're only entitled to..." when in fact it isn't the case because you are often given more rights simply from the terms of your contract. As much as you can't complain when someone does you a favour you also can't call it a favour when someone does exactly what they are contractually obligated to do.Bought, not Brought0 -
The reasons given by the OP doesn't entitle them to a cash refund simply because they changed their mind.
And I wasn't saying they did. It does however entitle them to a credit note/store card refund though, that's the thing, provided his HMV store has the same sign up as my local 3. It's a no questions asked 28 days return policy provided the item is not opened. Therefore the OP wasn't "lucky" to be offered what they were offered, they were entitled to it by the terms of their contract.Bought, not Brought0 -
