can anyone advice me with my problem with www.phoneboxdirect.com, Thank you

Hi everyone,

I recenlty purchased amotorolla v220 from https://www.phoneboxdirect.com. The contract offer was one of these cashback htingies, where actually you just pay the tx which is about £6 a month for 12 months as long as you sent back your vouchers. You get 200 mins and 100 txtx for this with o2.

I ordered the phone and whe it arrived it didnt work properly, it kept cutting out whenever i called anyone, it eventually wouldnt work all together, so i arranged to have it picked up and exhanged for another one, same model.

It came a day late and this one wont work either, i keep emailing them but they just ignore me, has anyone got any advice for me, as I am justa poor uni student paying out money for a phone i cant actually use at the mo,

any advice most appreciated,

thanks :)

Send them a letter by Recorded Delivery. Tell them in the letter that you reject this second handset because, like the first one, it does not work. Describe the fault as you understand it. State that you have contacted them previously via email, to no avail and that you wish to them to arrange to collect the handset and return you to your precontractual position.

When the nominated person or carrier collects the phone you must be sure to get a signature from the person who takes it. Also get the vehicle reg number and make a note of the date/time of collection.

If that does not produce the desired effect then you must contact Otelo and they will arbitrate for you. Phoneboxdirect are part of the Caudwell Group according to their website, and Caudwell are registered members of Otelo.

I think that their website is potentially misleading - it states that they are a trading partner of Caudwell/4u then with lots of information about Caudwell but I don't think that they are part of the same group. I think in reality they are an independent retailer who are supplied by Dextra (part of Caudwell) - which is not the same thing. If someone else knows different it would be worth clarifying.

Yes I think you are correct in what you say.

However, the original poster has statutory rights and these will not be affected by the fact that Caudwell Group are not owners of Phoneboxdirect.

I would advise the original poster to persue the matter via Trading Standards, rather than via Otelo, as it appears that Phoneboxdirect are not members. That is if the desired effect cannot be obtained by writing to Phoneboxdirect in the way I described.
