Tiscali-How do they get away with it?

I am going through Tiscali hell at the moment which has prompted me to post here for the 1st time.
I migrated from Tiscali last November (believing that the old provider and new do all the necessary cancellations of account, direct debits etc between them) but only discovered in August of this year that they had still been taking the monthly amount from a little used 2nd bank account of mine. ( that will teach me to take more notice of where the pennies go:mad: )
I contacted Tiscali and they confirmed the account was still active. The operator confirmed they were at fault and I would receive a refund for the amount owed and the account closed. Great I thought what a relief. 10 days later a bill for £5.16 arrived ( money owed on the closed account) I rang and spoke to another operator who denied all knowledge of admitting liability for their mistake and was in fact incredibly rude and dismissive. 3 days later a red demand for payment turned up. 2 more phone calls (1 again admitted liability another, none at all)
I then started to use email to contact them. Now depending on who picks up the email in their billing dept. the responses range from 'tough luck, pay us or court' to 'we are sincerly sorry for inconvenience please send us a letter from your new provider to confirm 'go live' date so we can calculate your refund. '
I promptly sent the letter.. and nothing.. so more emails ..now they want my name, address etc for 'date protection purposes' So here I am 5 months later with no refund and a company who it seems are stalling hoping I might go away..
Just to confirm I was told at the time of Migration that all necessary account admin (ie. cancelling) would be done for me...
So that is my ongoing experience of Tiscali...
