  • My husband received a`statutory demand under section 268 1A of the insolvency act debt for liquidated sum payable immediately`` 2 weeks past monday. I spoke to a solicitor who said it is not legal as was not hand deliverde nor did it have an official seal on it. We arranged to see solicitors this comming week yet this morning another letter arrived from Connaught Collections saying we`ve had the 18 days ( we haven`t ) & they are now in a psition to present a bankruptcy petition!!?? Thesum owing is £1439.00.
    We have tried contacting them numerous times...they aren`t open today, cant find a webste or email link. ANY ADVICE? Thanks.

    Hi IMM - I have sent you a pm.

    99.99% of Statutory Demands issued by Connaught are 'nothing more than hot air', but as you have an outstanding CCJ against you, then you do eed to seek professional advice - try one of the debt counselling charities, such as National Debtline - 0808 808 4000, CCCS - 0800 138 1111, or your local CAB.

    You need to establish the status of the outstanding CCJ - possibly need to apply to the courts to have it 'set aside' - you can try a pm to Penguin 83 as she is very good with court procedures.

    Whilst Connaught may, indeed, be 'phishing' you should not ignore the SD as it could result in them petitioning for your bankruptcy.

    New on here - I have just had a Statutory Demand posted to an address where I have not lived for over a year by Connaught saying that I have 18 days to reply.

    Bad news is that my other halfs parents opened it as i used to live with my girlfriend there - and she has gone bananas - more scared than anything as we have a baby on the way in December

    So under pressure I called them to ask what it is about - and they said it relates to a debt with Lloyds Bank - an overdraft from 5 years ago - there was a payment mande in 2005 for £50 and that since then I have done nothing, paid nothing and heard nothing from them.

    I am in a real state about this as it is for 3,127 and not the kind of money i have to pay. They were aggressive on the phone when I called and said that they would bankrupt me in 2 weeks if I did not start to either pay back or in full the debt.

    What do I do - I have been told by a mate that I am screwed now that I have called them as that is admitting the debt - all I have done is say that I had no idea about this but I did have an account with LKloyds and do not want go bankrupt.

    Where do I stand legally and what do I need to do?

    Don't worry about the phone call. 'Acknowledgement' of a 'debt', by you, must be made in writing.

    Talk to National Debtline - 0808 808 4000, CCCS 0800 138 1111, or your local CAB. They are Debt Counselling charities, fully endorsed by this forum, and will e able to advise you as to how best to deal with the underhanded tactics of CONNAUGHT COLLECTIONS.

    Another newbie here!
    With regard to the above company, I received a letter from then dated 01/08/2007 for an outstanding sum of £2800.29.

    The letter is a Statutory Demand under section 268(1)(a) of the Insolvency Act 1986. Debt for Liquidated Sum Payable Immediately.

    I maybe have been stupid, but due to being scared and frightened by this letter I have continued to pay it back up until now at £100 pcm.
    Do I have a leg to stand on for thi, or just continue to pay? Due to economic downturn I have unfortunatly lost my job and don't think I can repay the outstanding amount of £1600.29.

    Again, like most people on here, thi debt is from 1st Credit (Finance) Limited.

    Also with this letter I received another letter from DZIMITROWICZ YORK Solicitors, stating they have been instructed by Connaught Collections UK Ltd to send this letter before action.
    And should I wish to avoid legal proceedings, I should pay an amount with a reduction - this letter was STAPLED to the one I mentioned first!! Where is the logic!

    So I don't know whether I have acknowledged the amount and have to continue paying or should I ask for a CCA from them?
    Any help gratefully received!

  • So did the asking for the contract bit, a photocopy came yesterday with a letter saing i had to get in touch and pay £1252 within the next seven days. All signitures are in the right place. So is that me screwed. A visit and a county court claim? I certainly cant afford to pay it.
  • Hi, Some advise re 1st Credit. Back in December I received in the post a SD from Connaught on behalf of 1st Credit/Citifinancial. I foolishly wrote to them making an offer which they rejected. I then had another SD served personally on me. After reading all the forums, I sent a CCA to both Connaught and 1st Credit back in January this year and also completed form 6.4 & 6.5 to have the debt set aside. After sending the CCA I received a response from Connaught saying they had to request ths necessary information from the creditors and would take longer than the required 12days. To date I have received nothing from Connaught or 1st Credit but have now received a court date to have the SD set aside. I would really appreciate if someone can tell me what I can expect when I go to court especially in light of othe OFT findings aganist 1st Credit. I haven't received any proof they own the debt nor any signed documents. I own my house but have no equity so they aren't likely to get anything if I am made bankrupt.

    Please can someone help me with this, got 6 weeks to court date

    If the debt is in dispute, which it sounds like it is, then neither 1st Credit or anyone acting on their behalf (it should be noted that Connaught is part of 1st Credit [as is LCS Solicitors]), should be persuing this debt or they are in breach of the Requirements set out in Feb by the OFT. If this persists then write to OFT and send a letter to both Connaught and 1st Credit stating they are in breach of these Requirements and OFT have been informed. 1st Credit closed my file as a result. I'm not naive enough to think that's the end of the matter, but have now taken a little irritation away from me.
