overcharged by aol HELP PLEASE

Hi I have recently when checking my bank statements realised that aol have been double debiting my account {via debit card} since Jan 03, yep I know I should have checked more thoroughly but as it was the beginning and the end of every month it never appeared on the same statement. So I just glanced and saw aol and thought nothing more of it. This was until I cancelled my contract and then realised they were still taking the money.
To keep this brief they are saying that they can only refund up to six months [but everyone I talk to says something different!!! arghh.]
Is this legal ?? should I take it further or just be grateful they will give me six months :confused:
Any help would be appreciated.

    iam the opposite,i havent payed aol for broadband or phone calls since july!!! have a direct debit set up and they used to take it out at end of every month,nothing has changed with my bank,but they havent taken any money out since july

    i wouldnt bank on them notcing,thats been 6 months now,ok i should put money away for it,but at the end of the day it isnt my fault its happened i have always had money in the bank ot cover it so not sur e whats gone wrong,as long as i dont try and leave them i,ll be fine

  • Hi, I've had much the same problem, left AOhell in June and went to BT (another story). Life gets in the way and every month i noticed AOL taking money out of my account still. I have rung them several times in the last few months and the amount of times I have been told they have no record of some of previous calls leads me to believe their system is fallible. The last time I rang I told them so. I also said they were removing money from my account illegally and was thinking of involving the police. (I spoke to one of their so called managers). This resulted in a conversation about how I hadn't cancelled my contract. :mad: Apparently removing your phone service nd internet service isn't enough, they require a cancellation call as well. I replied that I did this and it was not my fault they do not keep proper records on their system. They wrote to me within days to say the contract was cancelled. Unfortunately this month I found them still taking money for the AOL Talk Pagage I no longer use. :confused:

    I realise this is a bit long winded but bear with me.
    I rang them back this morning and explained the situation, their lack of ability to keep records combined with BT records showing the time scale of my custom with BT and was just being fobbed off again. So I said, “AOL is taking money from my bank account illegally and if I don’t get a refund as soon as possible then I shall be asking my bank to investigate this illegal activity in my account.”
    Result?
    Full refund backdated to June of this year. :T

    Just be firm and remember you are in the right, and get your money back. It seems the bank threat held more sway than the police in this instance.
    Hope this helps, now I just have to sort out a problem I had with Virgin media who are trying to make me pay an outstanding debt from NTL who had no right to sell on a debt which isn’t mine to another company! Any help there is appreciated. Now I’m off to look for a thread on that!

    I used to work for Debit Card Services at Barclays and we used to get loads of complaints about AOL. If you have proof of written cancellation including email and your contract time is up then the bank should be able to get the money back from them on your behalf by using the VISA regulations and guidelines. This only works if they are taking the payments against your debit card number. Changing your debit card or cancelling it may not necessarily stop the payments to them. It does take some time but they should be able to sort it for you. I'm afraid I have no idea if you pay be DD how to get the money back but I would have thought it would stop if the DD was cancelled. Any bank that uses VISA on its cards uses the same guidelines and regs but its worth asking about. This can also be done on faulty goods, returned goods if they won't refund you and goods that have not arrived, including companies that have gone into administration.

    I would certainly ring the bank about double debits against your account. They should be able to help with that too. I take it you have bank statements or can get them.
