log book/ legal owner/disabled tax

    As others have mentioned the registered keeper is not necessarily the legal owner of the vehicle, as stated on the front of the V5C Registration Certificate/logbook.

    Also, to give you some background info on disabled tax, the vehicle does not have to be registered to the disabled person. The disabled person can nominate someone else to have the tax on a vehicle. The name of the nominated person has to appear on their exemption certificate which is issued by the Disablility Living Allowance Unit (DLA).

    This person is driving the vehicle illegally as the tax is now no longer valid. You can report this to both DVLA and the DLA. Write to DVLA, Swansea, SA99 1AR explaining the situation and quoting the vehicle's registration number, make and model. And ring DLA on 08457 123 456 for advice on their procedure.

    What normally happens on the DVLA side of things is that once a report has been received of fradulent use, then a warning notice is sent to the registered keeper advising them to return the invalid tax disc immediately and to re-tax the vehicle.

  • For the person that was driving your mother to have legal insurance, the car would have to be registered in their name.
    Illegally driving the car is a bit strong. Yes it is a road tax evasion but it is not endorsable and would be dealt with via an £80 fine probably (assuming he has not re taxed the car).

    The registered keeper is not necessarily the owner.

    Take a step back, dont let your grief cause you more worries and stress. Think about your reasons for pursuing this.
