log book/ legal owner/disabled tax

hi there
my mother has passed away last week
she bought a car 3 months ago,which i have a receipt in her name for.
mother was registerd disabled therefore had free car tax.
so she had a so called friend that used to drive her because she could not drive.
it transpires that the "friend" had the log book put in his name without her knowledge.
the car was also insured in the friends name.
I would like to know if he is the legal owner of the car, even if my mothers name is on the reciept.
and is he now driving the car illegally?
i thought i read somewhere that the car can only be used with the disabled persons free tax if the car is being used for the disabled persons benifit.

    Condolences at what must be a difficult time.

    For free car tax due to a disability, the vehicle must be registered to the disabled person:

    For the vehicle registration - presumably your mother's signature would have been required for the transfer to happen. Either it was obtained by misleading her or it was forged. This in itself may be a criminal offence.

    You could call DVLA to let them know and ask what they'll do about it (but find a non-rip-off number at saynoto0870).

    Regarding the tax disc, it's ownership now reverts to the DWP and should be returned to them.

    Presumably, you have informed them of your mothers death in order for them to stop any current claims? They should , in time, be asking you to return the tax disc, so you will need to inform this *friend* that you have to surrender it.

  • The reg'd ownwer isnt technically the legal owner.

    However they have fordged your late mothers signature, so they have commited an offence.

    The registered keeper and the owner are not necessarily the same person. Having a V5 in your name does not indicate that you own the title to the vehicle.

    He is driving it illegally if still using the tax disc.

    To Crabman, it's possible to get the V5 transferred without the signature of the owner.

    I want to build a good case against this person,we know he is using my mothers car illegally at the moment.
    When I go to the police I want to have all the facts correct,
    I dont know if I should mention this here but I am going to anyway.

    I actually took the car from him the other night and brought it home, with no force, i fooled him into giving me the keys.
    As you can imagine the police turned up at my house as he told them I had stolen "his" car, The police said as long as I return "his" car there would be no charges brought against me, I showed them the reciept with mothers name and address on it, they said as his name was on the log book its his car. there were 5 police officers at my house, mob handed?
    I have returned the car to his local police station for him to collect.
    I told the police about the tax situation but got the impression that they were not interested, hopefully they are interested and they booked him as soon as he left the station.

    Get a lawyer on the case.

    The police are misinformerd.

  • As above the registered keeper is not necessarily the owner. If your mother paid for the car, and you have that receipt, then provided he isn't suggesting that it was gifted to him the car will belong to your mother's estate.

    Go and get the car, and make a complaint at the police station.

    Hmmm.

    Gosh some interesting ones on here just now. My first thought was the car might be the least of your worries!! Have you checked her bank statements etc to see if any large amounts of money have gone awol in the last few months? Any changes to her will?

    I really think you should be seeking legal advice on this, especially if you can't get the police to investigate your claims. This could be very nasty.

    I stopped all mothers bank accounts on the day after she died,he would have not known any pin numbers anyway.
    I cant comment anything on this man on an open forum for obvious reasons,not that I would want to anyway, lets just say he is very well known to the police in town that mother lived in. I'm worried he will sell the car.
    I'm trying to build a case against this man over the weekend, while I am having a weekend off from the other arrangements I have to do.
    Tommorow I am going to go to the garage that mother bought the car from and find out if he filled the log book in at the garage, if so I am going to ask the salesman for a statement confirming it.

    If the garage confirms this, it could be my ace card.
