TK Maxx - no regard for consumer statutory rights

    Firstly, thanks for your replies.

    Secondly, Let me state for the record that I was really not rude to the TK Maxx staff, and there was/is nothing wrong with my attitude. I was just a little annoyed when writing this post - as I did so when I got back from TK maxx shop! Like Fitzy said - this board is for venting!! I just coundt beleive I was denied a refund.

    I didn't really have a massive argument, but more a prolonged conversation in which I told him how ridiculous this was, and that I should be entitled to my money back, at which point he gave me details for the customer service team.

    Anyway, we will see what they say tomorrow on the phone!

    I have yet to not get a refund or remedy necessary to resolve a situation by following that practice
    Depends on who and the Company you're dealing with.

  • I would not be surprised if it was just down to the staff member you spoke to - maybe even a personality clash.

    But refer to what I said above about part 5A of SoGA. It would be best to flatter them a bit (great produce, great prices, disappointed about what ha happened), and explain calmly what you want - a repair or replacement.

    There is a recent thread on here about shoes from TK Maxx. They got a replacement. I doubt you would be entitled to your money back - in fact I knwo you are not. A repair or replacement would be best.

    Go on that basis and you should be OK.
  • To be honest, the way the staff handled it was not good at all.

    I told the guy at the till that they were faulty and i would like to take them back. He took them straight to the manager who came back and said straight away they were not giving a refund.

    They did not ask for any explanation, or even seem to care. He just kept repeating that TK Maxx has a policy not to take back damaged goods. I don't think he really understood consumer rights to be honest.

    He didnt even offer store credit or anything else, he had made his mind up before he had even spoken to me.

    I think if there had been a different manager on iit could well be a different story..

    Was he the duty manager or store manager?

    Phone them up and ask when the "Store" manager is on duty, then pay him / her a vist.

    He was duty manager. We asked to speak to store manager but apparently he was in charge.

    apparently he was in charge.
    He may well have been on the day, due to it being the store managers day off, follow my advice above.

    I hated it when people said that to me when I worked in customer services. And if I did have anyone say that they paiad my wages, I responded by asking for their staff number as they obviously worked in payroll.

    It smacks of the erraneous attutude of "the customer is always right". This is not the case. the customer should always come first, but can never always be right.

    There are too many people working in customer facing positions in retail who seem to think that customers are just an inconvenience to their daily slobbing around.

    In the current financial situation, it is the customers who are keeping them in a job and therefore ARE paying their wages.

    If you've got a bad attitude, you don't deserve the job.

    Bad staff attitude
    Lose customers
    Lose jobs
    No customers, no jobs, no wages.
