If, despite all the strong advice to the contrary on this and other forums, you were daft enough to actually pay £40 to some dodgy private parking company, your chances of getting it back are slim or none - and slim just left the building.peter_holland wrote: »Is there any news with regards to martin's update on Private Parking that is under construction due? ie template letter so I can reclaim my 40.00 in fees?

Even with a court judgement against them, others have found that when the bailiffs go to collect the debt, they hide behind PO box numbers, dummy directors, and locked portakabins guarded by rottweillers.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
And if all else fails and you hand the judgment to them they just fold and morph into another company which prevents you getting the money.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I think that any appeal process concerning private parking companies is a farce.
Who do you appeal to?
The very people who sent you the ticket in the first place
The BPA only issue guidlines. They are not a regulatory body
There is no regulatory body so it appears that these companies are a law unto themselves.
Theres no Ombudsman
No independant judicator
The word kangaroo court springs to mind
How can that be legal?
Just to get a more true idea as to the success rate of appealing or ignoring these notices I created a poll and urge all with any experience to tick some boxes

You need to sue the parking company and the landowner in small claims court.
You need to research the legal ins and outs and prepare a proper claim. There is no 'template'.0
