  • I am not saying that. What I said is that the remedy available does not include a full refund.

    A full refund comes from recission of the contract, which can only be done if the goods have not been accepted. As they have been accepted, recission is not possible. That leaves the remedies I pointed out, or alternatively, claiming damages in court.

    When you say a "protected heel", do you mean that the part which has come off is the surface of the heel which would be replaced if you took them to the cobbler to have them "heeled", or do you mean that the entire heel part of the shoe has come off?
    If it's the latter, I'm struggling to see how the shoes can be worn at all.
    If it's the former, I've found that a couple of months' of constant wear is enough for the shoes to need "heeled", and they can reach a point of wear where the surface the mender would replace, has come off-and if this is the case, I don't think you do have a case to return them-do the OS thing and get them mended!
  • Just returned from TK Maxx and they were happy to exchange - I wasn't asking for a refund just a pair of shoes that didn't fall apart. They said they've never seen a pair of shoes where the heel came off both shoes after almost two months of wear - and said it could be a manufacturing fault. I've never had a heel come off either. Also got a partial refund, due to new shoes costing less.

    What actually happened is the rubber part of the heel, which on a man's shoe is quite big, came off on both shoes (Diesel loafers). And the only reason we noticed - apart from his inch drop in height - is all this wood chip stuff around the porch area of the house. Because the protective rubber bit wasn't there the wooden heel wore down considerably.

    I suspect the rubber heel wasn't fixed on properly, there were nails coming out of the heel but they didn't extend very far. Maybe they were factory rejects and that's why TK Maxx got them.

    i refuse to use th tk maxx in inverness,as it looks to me someone just reversed the delivery lorry upto the door and pushed everything out,nothing together or in a pair,having just come back from the usa,century 21 jumps all over tk maxx on how a shop like that should look like
