TK Maxx shoe refund?

Hi there

I bought a pair of mens shoes for my OH from TX Maxx on 2nd October. Just this week he's come home and both of the heals have fell off. We found one down the road, don't know where other is.

They cost £60 and were Diesel shoes, so I expected them to be high quality and not just last a couple of months. Anyway, since they don't have a protective heel they are falling apart pretty rapidly now.

Anyone know what my rights are on this with TX Maxx? I'd be happy with an exchange.

  • Goods have to be fit for purpose and last a reasonable length of time. I wouldn't say two months is reasonable. Take proof of purchase with you (could be bank statement if you don't have receipt) and if you have any hassle contact your local consumer rights and they will sort it out for you.

    why is this a vent? they will sort your issue out! surely its a vent when they dont sort it out for you?

    Forewarned is forearmed Butlers, should OP go in there and TK Maxx say "nope sorry we are not refunding you" OP will have the information they need to say "now hang on a minute the SOG Act says etc etc"

    but a big store like TK Maxx would see its a faulty item and adhere to the SOGA

    They should, but there have been a few TK Maxx customer service warnings on this board this year.

    All Im saying is, it doesnt hurt to know your rights beforehand.
  • I doubt a refund would be given. The customer has had them for a few of weeks, so the best that can be expected is a repair, replacement or pro-rata refund in that order. Of course the seller COULD give a full refund but need not do so.

    As a pair of shoes are expected to last for more than a few weeks, the OP can quite rightly claim that they are not fit for the purpose and should expect a full refund or replacement.

    In this particular case, they SHOULD give a refund.

    I am a bit puzzled how you came to lose one of the heels though?
    What do you mean when you say they don't have a protected heel?

    Im bemussed as to how you can say:
    I am qualified in consumer related matters, any posts are my opinion only.

    When the item isnt fit for purpose, should a pair of shoes only last a week?
