Need advice on 3 and Carphone Warehouse

Ok i don't know if this is the right place but i have a bit of a problem. Bascically:
I was due an upgrade from 3 mobile on my 20pound contract in November so i went in asking about how to go around it etc. I wanted to get the new Nokia N96(RRP 550quid) and i was told by them that they could only offer it me on a 35quid contract but i would have to pay 200quid for the phone alone. So of course i wasnt very happy with this and decided to shop around.
Then i found out that at carphone warehouse they have the Nokia N96 on a better 35quid contract and the phone for free and said they could upgrade. So i went in and started to upgrade it. They ran into a bit of trouble(Which ill explain why later) and after numours calls to their customer sevices and 3's it still wouldnt work. So the man said he did one the other day and used the code "...." to activate it. So of course he put it in and all was ok and i got the phone. He then said that he wasnt sure if it had gone throu thou. During this my mum signed a direct debit if that makes any difference.
So i went away with my phone. A few days later i thought id pop into my local 3 store as i know afew people in there and see if it got updated. It turns out that my account is still on the 20quid contract with nothing stateing that my account is changing. Not only this but it didnt even say that i had recieved an upgrade and they are now offering me another phone and offering to upgrade the contract for me
Since then i have had my bill and was still only charged 20quid and i have not recieved my new minutes and it still saying im on my old contract.
It turns out that they wern't supposed to upgrade my contract through carphone warehouse as to upgrade though 3 with them you have to be in your last month of your contract and im 3 months away from that so apparntly it wont go though at all.
Does anyone have any idea where i stand on this? Because my girlfriend had her phone stolen not long ago and is in dire need of a new phone and would be the perfect christmas present

Should i just upgrade again to 35quid contract and pocket both phones as surely its there folt?0 -
i would check with three that you don't now have 2 accounts. my bet is you have 2 accounts now, as no way can you be upgraded to a £20 tarriff on an n96, it's a money looser. why was your mum signing a direct debit? you don't need to re-set up a direct debit to upgrade???

I think you were set up with a new contract by CPW - so you will be paying £55 a month:
£20 existing contract
£35 new CPW contract.
I would suggest not upgrading your old '3' contract, unless you want to pay £70 a month...0 -
Be careful there, I think it maybe worth calling three and checking out that they dont have two accounts set up ie new contract for £35 and old contract £20.
My auntie has been caught out with a similar situation and three have the worst possible customer service and refuse to cancel the old account.
I am in dispute within them as well and presently in a middle of a claim with their ombudsman.

Thanks for your advice everyone. I have just phoned 3 and they have told me i only have 1 account open at the minute under that name, which is the 20pound texter. They also asked if i wanted to upgrade? So Im guessing the carphone warehouse upgrade never went through at all. I think Im going to phone them now thou and make up some excuse to find out whether they have an account.
If not then im guessing im all in the clear?
It may not have been a direct debit then that was signed but she had to sign a contract i believe.

After several attemps i finally got through to carphone warehouse.
I asked whether i had an account open with them and they said i did and it was an upgrade. But he said 3 should have upgraded my account by now, which they havnt so im not sure whats happening. But they confirmed it was only an upgrade.
Im tempted to go in and upgrade the phone and go onto the 35quid one. Then log into my 3 account and change my phone to the N96. Then if there any disputes it looks asif im on the 35quid texter. And if the worse happens (apparntly the people in my local 3 shop say won't in a million years) I can just give back one of the phones.
Because surely its not my folt and i could just say that i was offered a phone when i went in and (being niave) say i wasnt sure if i was due another phone, and pretend i didnt know about the N96 yet as my mum secretly got it as a present
haha. Any help would be lovely!!0
