    My sister has just taken me to Comet, i got the refund - no questions asked. I took her down to show her the model it was and the sales assistant on the floor said to me 'don't go for that one mate - we aren't getting any in anymore' so i explained the situation and he said he wasn't surprised. Head office had phoned the store and told them they will not order anymore in. He said they were just issuing refunds. I don't see the point in complaining to head office if this is the way they treat their stores (although i have complained already.) I'll let you know what response i get from them.

    Although they have done me a favour. I found a better model on the net from ebuyer and saved myself £300.

    You can issue in the small claims court online at https://www.moneyclaim.gov.uk

    You should email/fax a warning of intent, say 5 days, although not crucial,.

    If they defended, it is probably the case that their Terms and Conditions, to which you probably signed agreement to on the order form, state that oral representations are not to be relied upon and only written representations have validity. This is standard because after all it protects a company from what a commission hungry sales rep might say.

    So they probably have a good defence but......in the Small Claims Court it will cost them far more than £200 to pay for their defence and, if they win, they will not obtain an order against you to pay their costs. Only for claims over £5K can a winning party get an order that the losing party pays. However if you win , because they withdraw, you will get an order that they pay you the court cost of issung the claim. So it makes no sense for them to not either deliver your screen now or repay the £200.

    I would write first. To ensure they believe your threat to issue is a real one I suggest you open the case on the court website up until , and including, such time as you enter the nature of the claim - then do a screenshot image and attach that to your email. Do not pay and do not issue just yet but say it is teed up ready to issue once the 5 days expire without repayment or delivery.
  • Can somebody please advise me how I stand on the following:

    I visited my local branch of Comet last week to purchase a new tv. Saw a nice shiny one, a Sagem HD L32T on offer for £999. I deftly collared a salesman (tricky beggars to pin down) and signed on the dotted line for 12 months buy now pay later for the tv and a glass stand. Told by sales peep that delivery would take place at my home address on Friday 13th (bad omen) January. Paid the usual 10% deposit by credit card.

    I have now been 'phoned by sales peep today and informed that tv out of stock forever, blame Sagem as they are behind on orders.

    Can anyone advise how do I stand with Comet.....just cancel Credit agreement + try for a different Tv or is there perhaps some other option available to me?

    Sales peep not exactly forthcoming with company policy on this situation.....I did point out that they were probably in breach of (at least) the Consumer credit act 1974.

    Can't be bothered to take them to Small Claims court, surely there must be some kind of redress through The Sale of Goods Act. I have now discovered that they actually removed the Tv from their website on the 29th of December.

    Very annoyed with Comet will be happy to get my money back.....they have already offered this to me but would obviously prefer a new tv.....come Friday there will be a very large space (32" Philips CRT set sized) to fill in my lounge :mad:

  • :eek: Got another call from the sales peep at Comet today (sounded rather sheepish) to tell me that have sourced a my TV. I should receive a brand new (shiney shiney) unopened one delivered to my door on Sunday :rolleyes:

    Hopefully this will conclude the matter without any further snags!

    If this works out I may yet shop again in Comet another day :A

    off the subject slightly Itook my mam and dad to comet to buy a new fridge. when we arrived i headed strait for the big tellys and left my parents to shop for a fridge. when i went back to them they told me they found the one they want but the salesman told them they didnt take barclays debit card but could set up for them 12 month intrest free credit. when i pointed out that they did take the card he said "oh ill just go check again"
    we paid for it on the card but i wish we would have complaind about his lie and gone somewhere else. I wonder how many people have fallen for this trick?

    glad the problems have been sorted. i think comet are useless there customer service is !!!!!! i got a washing machine over a year ago few months after buying it it was doing crazy things on spin cycle codes coming up had someone out 3 times then phoned them up and told them they could have the machine back as it was not fit for the purpose intended and i wanted a new model so a few weeks later and some talks with trading standards we got a call to come and choose a new machine ! but NEVER will i shop at comet again !
