Tricked by Comet?

I put a £200 deposit and signed a credit agreement for a 42" plasma tv from Comet on the 27th Dec only after being told by the sales advisor that they were having a delivery which i could collect on the 2nd Jan (he said he checked the computer. Phoned on the tues to check- no delivery told delivery coming today.

So i phoned them this morning and they said they had a delivery of 80 and i could collect my tv on monday. Woohoo i thought. Until my sister (unknowing that i had phoned) phones them to ask about it and she got told that they had not got a delivery and did not have a due date so i could be waiting weeks.

So i ring them again and the lady tells me that there was no delivery and she can't understand why i was told today and by the sales advisor that there was a delivery.

Anyway, my point is - i think this was a con because the sales advisor knew that if he had a said i would be waiting weeks then i wouldn't have bought it, so he lied (and the woman on the phone who said about the delivery of 80.)

I am thinking of emailing Trading Standards because i feel i was tricked into buying it and also making a formal complaint to head office, does anyone think i have a good enough arguement?

    I think that you can put on an order the words something like@ delivery by .. or this order will be cancelled', not sure of the wording and I don't think this will help you this time, but may be for future reference. sympathy over current situation tho, although not surprised!

  • Get your money back, if you agreed a date then that formed part of the contract which they have broken by not fulfilling - and learn a lesson - NEVER GO TO COMET!!

    Are they really bad?? I've never heard of any bad stories about them (that i can remember) Now i'm not talking about suing but do i stand anywhere with them breaking the contract? I have emailed a letter of complaint to Comet head office (via the howtocomplain.co.uk) and also i have sent an email to my local trading standards to ask their advice.

  • I think they are absolutely awful! terrible service when things go wrong, but always smiling when they take your money! If you specified the delivery date when you ordered then that was a term of the contract which they have now broken and you are entitled to your money back - no if's or buts! From my experience though they will not give you it - if you have a spare £35 file a claim against them in the small claims court and sue!

    We ordered a bedroom suite from MFI a couple of years ago. All except one piece of furniture was delivered and installed. When they didn't deliver the last piece by the date agreed and couldn't give us a definate delivery date we said they were in breach of contract and they had to come and collect all the items they had already delivered ( and we had already put together) So yes, if you order something and are given a delivery date it does become part of the contract.

    Yep I agree, You agreed a contract for pick up on Jan 2nd, you have graciously allowed them an extention, but now enough is enough, especially as you have been misled about a delivery on Monday.

    You are entitled to cancel the order and get your money back. In the event they disagree, your case will get stronger after 30 days.

    If you paid by credit card you can ask for a charge back from your card issuer.

    Hi

    A friend of mine worked for them briefly and the tricks they get up to is disgusting. Never take the salesmans advice, their opinions are formed on the commission they earn per item. Also, it does not necessarily follow that the more expensive items will earn them more money. If there is a promotion on, on a certain item then the commission rates will be hiked up accordingly to encourage the sales advisor to push certain products more than others.

    NEVER take their insurance out - the sales guys make alot of money pushing this at you. I always say that we self insure - by that I mean we have money saved to ensure we can afford repairs if and when we need it. That seems to put them off pretty quick.

    In this case I guess that by selling items that they know will not turn up may have earned someone a BIG fat commission cheque with bonuses for the Christmas period. I would bet that is what has happened here.

    Why the heck does anybody ever believe the old 'we are gettnig a delivery in on XXX' line. Nine times out of ten that is just a ploy to get someone to sign up. I would simply try to cancel the order and ask that all monies be refunded to the account. The only possible issue might be with the company offernig the credit (particularly if you have agreed to pay a certain amount of interest) ... like others though I would have thought that Comet have failed to deliver on an agreed date therefore they should deal with the credit company.
