Bank a/c with minor crim record ??

Hello

Does anyone know, if you have a crim record from over 10 years ago for very minor fraud, can banks find this info out on a search ?

Not mine but asking on behalf of a.n.other, who got accepted for A&L a/c then retracted 'on further checks'

This information may appear on either

    Hunter

    http://www.nhunter.co.uk/

    or CIFAS

    http://www.cifas.org.uk/

As the crim record is fraud it may well appear via these additional searches that are performed by the banks.

You could do a subject access request to them both under data protection legislation.

Cost £10 each maximum and they have to send you a copy of all information they have on you.

If the fraud was against one of the owners of Hunter for instance i would think they would have recorded it. Hunter was setup and is owned by most uk banks and is administered by experian.

These checks will have been performed overnight after the account was opened at A&L.

From what I have read A&L should not be allowed to automatically decline the account due to the result of the checks. A person needs to review the result so there maybe an appeals process.

I would expect each bank/building society to perform these fraud prevention checks and your friend would run into this in the future with other organisations.

  • As far as CIFAS goes, the 'friend' would be able to see whether or not he has CIFAS registered against him or not. Also, it could simply be that the 'friend' put inconsistent info on his application form or something. A 10 year old fraud wouldn't necessarily be on Hunter or CIFAS. Was Hunter even around 10 years ago?
  • Also, hasn't the 'friend' applied for other bank accounts and credit products during the past 10 years? I'm sure he has. So if the crim record was a problem, how would he have been able to have any kind of bank account, credit card, catalogue etc all these years? Or has he just got out of jail?
  • Thank you BenL for your advice, my friend used a dodgy rail ticket, he wasn't aware, so we will ask the decision of the bank as you mention.

And no moneysavingallday he hasn't just got out of jail, he didn't go to jail. Please don't be so judgmental. He hasn't used banks/cards etc for years.
  • NINCOMPOOP,
so if your 'friend' has had no problem using banks and cards for years, why should a 10 year old conviction suddenly cause problems now? Since the conviction is for using a dodgy rail ticket, then I would think it unlikely that details of this would find their way to Hunter or CIFAS. If A&L won't play ball, perhaps consider taking your business elsewhere as A&L seem to have got pretty ropey reviews on here anyway.
You and your 'friend' should be just fine. Good luck ;)

If he hasn't used banks/cards in years that will be the problem I guess. He'll effectively have no credit rating so the companies will not be able to judge if he is a good risk or a bad one.

I would suggest going into a bank and asking to open the most basic accounts of all one that is allowed for people with bad credit ratings. But remember the more applications you do the more you will look desperate and consiquently be rejected.

I'd recommend he apply for his credit ratings and see if there is anything showing there. You can do this by post for £2 I believe.

Using a dodgy rail ticket although fraud, has absolutley nothing to do with the financial services industry and opening bank accounts and applying for credit.

In fact for the rest of your friends life the only way someone will find out about it is if they apply for a job working with vulnerable people, where they carry out a criminal record check which includes spent convictions which I imagine this must be.

Some banks will take a letter from a Prision Warden as proof of ID, so dont worry about it. Much of the information above is not applicable to your friend.
