Being Charged 40 quid to disconnect

I signed up to UTV internet over a year ago and rang up to check my terms as I wanted to take advantage of a Sky + deal (which was going to work out cheaper even with all the additional charges we get stung with for (god forbid) living on an island smaller than Britain!!! I was told I could cancel any time and just had to complete a form and return (which I did). I then received a letter telling me that they (UTV) want a £40 cancellation fee (wich they will take out of my bank account) and want the modem I had to pay for at the start back (was only £19.99 but still, I had to pay for it). If I don't return it they will charge me £40. I AM NOT HAPPY. I have checked all of the paperwork (all done online) and tried to find and look at the terms and conditions on their website but can find NO reference to charges or returning modems. ARe they taking the michael here? I am not convinced this is legal? PLEASE HELP...

It seems pretty clear from para 16 of this: http://www4.u.tv/UTV_Internet/Residential/ClicksilverBroadband/T&Cs/Clicksilver-BroadBand-TC.htm that your minimum contract period is 12 months, and that during that period you have to pay up to the end of the 12 months, but nothing after that OTHER THAN to return the modem in exchange for a refund of the (presumably subsidised) amount you paid for it.
But the details on their homepage talk about a £40 cancellation fee - which is not in the contract.
They haven't a leg to stand on, apart from asking for the modem back - but then they would owe you £20.
You have to give 30 days' notice, though.0 -

Lady was not happy and said I did sign up to terms but I have checked paper work and website and would dispute this! Will keep you posted - thanks again.0
