Cancellation Charge and they want Modem back!!!

I signed up to UTV internet over a year ago and rang up to check my terms as I wanted to take advantage of a Sky + deal (which was going to work out cheaper even with all the additional charges we get stung with for (god forbid) living on an island smaller than Britain!!! I was told I could cancel any time and just had to complete a form and return (which I did). I then received a letter telling me that they (UTV) want a £40 cancellation fee (wich they will take out of my bank account) and want the modem I had to pay for at the start back (was only £19.99 but still, I had to pay for it). If I don't return it they will charge me £40. I AM NOT HAPPY. I have checked all of the paperwork (all done online) and tried to find and look at the terms and conditions on their website but can find NO reference to charges or returning modems. ARe they taking the michael here? I am not convinced this is legal? PLEASE HELP...

I also have decided to cancel my UTV quicksilver account...they posted me a letter requesting "their" modem back (eventhough i paid for it back in 2005) and wanting a £60 cancellation fee!!!!! It doesnt say anything about a fee in the T's and C's....It's a great day for singing a song / It's a great day for moving along / It's a great day for morning to night / It's a great day for everybody's plight.
Your father pedals car telephones at a 300 percent markup. Your mother works on heavy commission at a camera store. Graduated to it from espresso machines. Hah!0 -
Have a look at the reply I got about the cancellation charge!!! Looks like there is no way round it!!! I will so recommend that noone ever goes near them. They are so sneaky - I am fairly computer friendly and it took me an hour and I still couldn't find it in the small print. I am going to complain to whatever level I can. I think it is really really bad!!! All the british companies screw us for living where we live and now an NI one is at it too!!!0

The Wireless modem is a Netgear DG834 G and you must have an Ethernet port on your PC, Laptop or MAC for it to work if you are not utilizing the wireless capability. Range in ideal conditions is up to 50 metres indoors and up to 250 metres outdoors. The wireless modem remains the property of UTV Internet at all times and it must be returned to the following address if you terminate your service:
UTV Internet, Ormeau Road, Belfast, BT7 1EB.
Failure to return the wireless modem will result in a charge of £40.00 as well as the normal cancellation charges, where applicable.0 -
IT CERTAINLY DIDNT SAY THAT ON THEIR HOMEPAGE BACK IN 2005..AND IT TOOK ME MORE THAN 10 SECONDS BACK THEN!!!
They didnt send me a Netgear DG834 G but rather a bt voyager 2110...could this be a loophole !!!!

Not a loophole, the 2005 conditions apply to your deal, those quoted are the current ones.
Your best "loophole" though is that you say you paid for your router. If that's the case then they can't make you give it back!
(Loaning hardware goes on in the mainstream - eg. o2 only lease you the hardware, and when you leave you must either return it or pay for it)0
