Insurance claim made against my wife, how to respond?

  • Ok I'm going to put an edited google maps image up for a small amount of time, we had done this the same day as the accident btw.

    I just want to point out that my wife WAS indicating.

    As they say, this thread is worthless without pics!
  • Also, I appear to have gotten the wrong impression about where the woman came from, I thought my wife was of the opinion that she came from the give way junction but I was WRONG, I guess that was just my impression and I apologise for the mixed information. My wife believes the other lady was in the lane next to her at least as far back as the second set of lights.

    I apologize for any confusion caused, my wife wasn't present at the time I made the post!.
  • Ok here is the google map thingy, I will probably remove it after 24 hours but I suppose I could forward it to anyone who would like to see it afterwards.

    The blue dots are my wifes course up untill the accident and thereafter show where she was heading.

    The green dots are the other ladys's course as far back as my wife can be reasonably sure.

    The red circle is where the accident happened and the yellow x is where they pulled onto the grass to exchange details.



    I will try to answer any question as best I can (with my wife present this time)

    Again I apologise for the mis information which is my fault entirely, I hope this map helps clarify the situation.

    My wife had a similar accident. But from the other side.
    She was going round an island, intending to go straight over, in the left, nearside lane. She somehow made contact with a car on her right, who she swears was trying to overtake her.
    The end result was both offside doorskins were peeled back on my wife's car, and the other car lost it's front bumper, and nearside wing was damaged.
    The insurance companies automatically blamed my wife, as the nearside car was always held responsible apparently.
    So at the end of a long story, your wife should be the innocent party, and the other woman should be assigned the blame, in the absence of any witnesses or other facts.
  • Just to update, we sent everything off and the insurance company forwarded the information to the other people's insurance but so far they have received no response!

    My wifes provider have said that they believe the other lady was negligent and that the length of time it has taken to respond means they have probably given up but it remains to be seen what will eventually happen!

    Just to update again, this still hasn't been settled.

    We have received an erroneous phone call from the other party's insurance company!

    They rang and didn't even confirm identity, just began discussing this lady and her husband's "statement from a few days back" we politely informed them that they had rung the wrong person and also informed them that the husband wasn't present so he shouldn't be making a statement.

    Our insurance company said that they fully believe my wife was in the right but that the other side is trying to go 50/50 which they have refused and we are still waiting to find out.

    All this time my wife has been paying a higher premium "just in case" as her insurance company put it, She is getting very frustrated by how long this is taking.
  • I hope it gets sorted out soon. I can understand how you feel about it taking so long.

    Had a simular accident about 2 months after starting, wont go into details, but it took them until 2 months after i left the company and I never found out who was blamed for it so it has screwed me over for insurance as I have to wonder if I should put on that I had made a claim or not, as it was company insurance so they made the claim I think.

  • This Still Hasn't been rectified!

    The other party claim £3800 of damage was done to their car yet my wife's car has a tiny scratch that we don't even know was caused by the accident for sure. My wife's insurance company are well aware of this and are basically saying don't be so stupid but they are not giving in.

    It's been over a year now, I can't believe it. They say her insurance company have amended their original account significantly too. The first account matched my wife's in regards to the exact piece of road it happened on and basically put the other driver in a position where they must have either been in the wrong lane or failed to give way which my wife's company discovered when they physically visited the site themselves but since then they have claimed the accident happened 50 or so meters from where it actually did.

    I don't understand how they can carry on being stubborn when they have changed their story and claim for damage that physically isn't on the car!

    Talk about a nightmare.

    I'm sure her husband is behind it all, the other lady was all apologies at the time claiming she didn't know where she was going but as soon as my wife talked to her again on the phone the husband was in the background telling her what to say.

    To make matters worse the other ladies insurance company phoned us by accident to discuss her "and her husbands" statement, why is he making a statement when he wasn't in the car? What a lying git!
