Cash Credit card fraud and being held as negligent

Hello all.

I'm worried sick about this so wondered what people though please.

My husband had his wallet stolen while on a training course. He was at a hotel, went to lunch where hotel staff said the conference room would be locked. A man was loitering in the hotel lobby, he went in and stole my husbands wallet.

My husband stupidly had the pin for his Barclaycard in the wallet so the thief got 2 cash transactions of £250, then went into a post office and got a further £900. This was in a matter of hours.

Barclaycard are now saying he is liable for the full cost. On top of this they have put on all the charges and interest. They said we can appeal.

They raised his cash limit days before the theft, so my husband didn't get the letter until weeks later advising of the cash limit raise.

My husband has never taken cash out on his credit card. How can someone even take out £1400 cash in one day, I thought there was a limit?

Any advice greatly appreciated.

    There should be a daily limit, however when my daughter's card was cloned at a tube station machine, some lowlife managed to withdraw the equivalent of £1,000 in a single day from New York City. The daily limit on my daughter's card was of just £200.

    In the end, she was refunded all the money.

    BUT, has your husband told the bank the pin number thing???
  • This happened to my boss in exactly the same circumstance!
    He also had a Barclaycard stolen and £450 stolen almost immediately.
    He got the money back no problem.

    I would advise him to appeal and ask them how they made the transactions.

    If all else fails he can take his claim to the Banking ombudsman.

    Golden Rule 2 - Never leave your PIN in your wallet or anywhere else.

    Just change the PIN to something you absolutely CANNOT forget.

    Make sure you contact the police to tell them of a criminal act/s, get the reference number and return to your bank.

    Sorry to sound pessimistic, but if he was negligent with his PIN, thhen I don't think he will get the money refunded.
  • Leaving your PIN in the wallet IS negligence. It states quite clearly when you get your PIN that you should NEVER leave it in your wallet, and that the PIN letter should be destroyed immediatly.

    If the card company know about the PIN in the wallet, Im affraid you are probably liable for at least some of it, probably up to the daily cash limit on the card. They shouldnt have let more than the limit out after all.

    If all else fails he can take his claim to the Banking ombudsman.

    Don't know how far he would get with this as he left the PIN for the card in his wallet with the card...

    How on earth did they manage to get £900 at a Post Office? You can't get cash with a credit card there at all.
