    Can I take it that both you and your partner heard the EA promise that "everything in the show flat" would be included in your place? Because the testimony of two people is generally taken as reliable evidence in English law.

    You would probably have a strong case for holding them to the deal, as you understood it. However, you are probably well out of it.

  • Back in August myself and my fianc! went and had a look at a brand new flat. We weren’t looking to buy at all as we don’t actually have a deposit and are currently trying to organize a wedding.


    Is it just me or is anyone else confused ? why would you go and look at a flat when you know you cant afford one ?

    Hi there, as I said the fact that they would pay 5% deposit and the flat would come fully furnished meant that we could afford it.

    An alternative would be to forget the deposit and gazundering them £5,000. Let them feel your wrath ten-fold :D .

    The price of property has decreased since August. You said they reduced their price immediately on valuation, meaning they're very keen to sell, probably even more so now that it has dragged on a few months.

    The EA may have made a pricey mistake for the vendors!
  • Ah..... So you knew that before you viewed it so you could afford it.

    Still Like others have said unless you have something other than your word against theirs its looking like you may lose the reservation fee
  • The receipt for the £500 holding deposit does not say that the deposit is not refundable and we were never actually told the deposit was not refundable.
    The EA are now saying that they passed the holding deposit to the builders (Henley Homes) and that they are not willing to give it back to us.
    But, we paid the deposit to the EA, not the builders, the receipt was signed by the EA, and also, they were the ones that lied to us…

    Have you contacted the most senior person at the EA's yet? If the furniture can be sorted out, would you be happy to proceed with the purchase & therefore not require your deposit to be returned?

    You have no deposit, weren't even looking for a property, & were seduced by a free sony plasma telly!

    Does the TV work? They often don't in these places - no-one's watching them.
