    Yay! i found my witness today he remembers every thing , so going to phone my insurance with his details tomorrow,Thankyou God ! and thankyou everyone for all of your answers, oh and idiot man reckons we were reversing out of our positions at the same time , trying to claim 50/50 well he can bog off! Thats why the rear side if my car must of got damaged and i had to get a respray and a new bumper! Please let this go in my favour as i am a honest person and idiot man is a liar liar! wish me luck , i will keep you updated as you have all been so kind answering my question.And yes i have got legal cover and i will see this through to the bitter end , bring it on idiot man! 50/50 no way!

    Good for you. I can't see how they'd entertain you having any fault at all with it being a side impact.

    If it's an independant witness why not? Perfectly ok.

    The witness would have been provided immediatly if the OP had an idea had an idea it would be contested.

    Thankyou cyclonebri1;) I am more worldlywise now, i have spoke to my insurance and gave them the independant witness name and telephone number and they said leave it with them now,and you are right i would have tried to find the witness man earlier only silly me:o thought i wouldn't need him cos idiot man admitted fault:A
