Someone Reversed Into My Car
At the time this idiot did this he got out of his car and apologised to me, gave me his insurance details and left , because this person was in a hurry,there were no witnesses to this accept for a man who was passing by and i did not get his name ,but i do see him around the car park alot so i may bump into him again and i could ask him to be my witness:rolleyes: , i phoned my insurance up when i got home , they sent me a car to rent and they took mine away for repair , the car took 11 days to be repaired and returned to me, i sent the courtesy car back which cost about £1500 i have not paid for this or the repair for my car, i have now recieved a letter from my insurance company which to my horror :eek: says the other driver is not accepting liability for the accident , he is making another story up,What do i do now:eek: am i going to lose my no claims bonus i have several years,who will pay for my car and the courtesy car and is there anyway to prove this man was in the wrong:mad:

Was there CCTV in the car park? I'd suggest getting in touch with the car park owners/administrators to ascertain whether they had any coverage there.0 -
What story is he making up?
You claimed first - that should weigh slightly in your favour. Do you have legal cover in your policy?0 -
This is an oh so typical situation. 2 cars have a knock, one drive knows he is in the wrong and the other believes he is in the right. Instinctively most people say sorry when something likes this happens, but, after time to consider the cost, lost NCD etc the party in the wrong decides to do what the insurance company stipulate they should have done in the 1st place, never admit liability, just furnish the facts and let the insurers do thier job.
If you can find the witness and that needs to be sooner rather than later, then any statement should be taken at face value.
How about a few more details of what happened, for example if you were both reversing at the same time then it's pretty much 50/50, if you weren't in the car at the time that is very different

Are you fully comp? if so your insurance will pay the lot minus your excess, the outcome of the argument decides if you pay the excess and lose the NCB. It's abit more difficult if you are 3rd party only, as this only covers damage to the "other" carI like the thanks button, but ,please, an I agree button.

Thankyou cyclone I am insured fully comp.I was parked next to idiot man ,I had already reversed out of my parking space and turned facing the way out and i was in a stop position ready to go out of the car park then the idiot man who was next to me decided to reverse too he obviously wasn't useing his mirror or any obsevations he was in a hurry don't forget, in his brain there was only him in the car park ,how he never seen me i don;t know,i hope he doesn't get away with this, i am currently camping in the car park waiting for the witness man.0

I don't mean to jump in when I don't drive a car, i'm a perfectly good experienced passenger though.
I have never been in any accident, but I always thought that the insurer, in cases of conflicting stories would assess the damage to the cars.
Surely if you were hit from the side and there is damamge to prove, damage to his car, if any, would show that it was a back to side collision. There is no way, that I can think of, that would cause this damage in this situation, other than a person hitting you.
Do you know what the story is he coming up with? Unless it is completely different to the events, like position you were in, and where you are, I would think that the only logical conclusion they can come up with, is that the man hit you. You cannot hit someone side on.0 -

So it's a no brainer then. His insurance company are just using the standard "never admit liability" routine. Use your legal cover to fight it - that's what it's there for. You DID pay that £20 for legal expenses didn't you?0 -
This just happened to my son. A car shunted him from the back. The driver did not see my son stationary and indicating, anyway, my boy only has 3rd party fire and theft but took out legal assistance.
His ins comp passed on his details to a legal team who managed to get my son £3,500 for repairs and they also paid out for the hire car for 2 weeks.
We were lucky though as a witness gave us his details there and then, also the other party accepted the liability.
Good luck and keep calling your insurance, they have to act for you.
ps. you should not loose you no claims as you will be claiming from the other party insurance0
