    It doesn't matter if the parking company is one employed by the Uni. Student doesn't pay, company informs Uni, student then hauled up for not being in good financial standing, course suspension or dismissal, more fines and/or withholding of certificates.

    It's in a lot of Uni "Student Conduct" sections.

    It may well be the correct advice if it is an unenforceable ticket.

    Or should University students go through life being gullible?

    It matters a great deal if the PPC's conduct is in breach of the new consumer regulations. Or if the invoice may be unenforceable.

    Considering the university will not be able to prove the identity of the driver, they're on decidedly dodgy ground. I'd love to see them try it.

    Dont think anyone was aware of th university rules when lots of the early posts were done.......

    Still dont thinks its enforceable anyway.

    Irrelevent. Failure to pay is a breach of the Student Code of Conduct - a CONTRACT the student makes with the university so regardless of all your bleating and hand wringin, it's a purely civil contractual matter between the student and the university so consumer regulations etc don't apply and if the student doesn't pay if the university say it's valid, the sanctions can be made. You're completely missing the point that the universities use "not of good financial standing" as the reason why they take their actions. The sanctions are made solely on the fact that it wasn't paid, not whether it was legitimate or not. The correct action is to pay then appeal and then you don't end up foul of the "not of good financial standing" clause. The view of the universities is that if you don't pay, you don't have sufficient funds.

    So are you saying that if a person doesn't pay something that they, in law, have no reason to pay then, the University will take sanctions against them?

    Fair enough if that is the case but does seem a little harsh IMHO.

    As has already been mentioned how would they necessarily know who the driver is/was on every occasion?

    If the matter is contractual, then the university have erred in referring to the invoice as a penalty, in that case.
  • It matters not what they insert into a contract. You cannot sign away your rights. The University has no idea who was driving on the day.

    Is it worth the risk if he could get chucked off his course and potentially ruin his LIFE career oppertunities for a parking ticket that he deserves, agreed by signing the student conduct contract, but just cant afford???
