I missed this question over the weekend.
This is a PCN and there will be a Warrant of Execution issued by TEC at Northampton County Court that has now been sent to bailiffs. Unlike council tax collection where the bailiff has no idea whether you own a car, the warrant of execution states on it the registration number of the vehicle at the time of the contravention. In this, if that same vehicle is outside or close by then the bailiff will know that this is your car.
It is not good enough to just receive a PCN as it is merely a notice to advise you that you have 14 days in which to pay at 50% reduction. The next document is CRUCIAL. This is the Notice to Owner and ATTACHED to it will be a REPRESENTATION FORM. This is the form to fill in if you wish to complain about being issued with the PCN.
A little known fact is that the majority of local authorities have contracted out the printing and posting of the Notice to Owners.....to their relevant bailiff companies. Many people are now starting to ask questions as to why they are not receiving the Notice to Owner to allow them the opportunity to make a complaint (answers on a postcard please !!!)
If you have not received either the original of the PCN or the Notice to Owner then you have grounds to complete an Out of Time Statutory Declaration. The Civil Procedure Rules provide that ALL enforcment must cease once this has been completed. If you are considering doing an Out of Time then you need to ensure that you call the bailiff co and they will get a message to the bailiff. This should stop all action.
Due to the desperate delays at TEC it is taking approx: 2-3 months for the Out of Time to be decided. If your application is rejected you can appeal and this is taking another 2 months.

well things just got worse for me but im still managing i have had a letter for non payment of court fines from my younger days this morning and my broadband connection was disconected due to non payment..but im still here trying to get on top of all this as soon as poss0

also have two more parking fines whick havnt been sent to court as yet think on wednesday the one will be sent to court but a can make a payment plan with them but as i didnt have internet i had no way of finding all info i needed today has anyone had any exsperiance of writing to pershore office what do i need to write in letter can send fax with computer and scanner as havnt got money to send fax what a pickle ive got my self into0

ref the parking fines due to go to court, I think you may be able to make an arrangment to pay a very small amount each month, which would prevent them getting to the bailiffs if you kept up the payments.If you've have not made a mistake, you've made nothing0 -

RAS makes a very good point here. Don't let the fact that you have had one PCN go to bailiffs mean that you let the others slide in the same direction. You don't have to let that happen and it really will save you a lot of trouble. If you're getting to the stage where you're having a lot of stuff like this hit at once then you might consider getting help with debt management overall now, before things get even more serious.If you don't stand for something, you'll fall for anything0
