    I'd move any valuable possesions NOW.........

    Regardless of the value of stuff they find........You may find you get charged for the baillifs time and the auction houses storage...........

    Your £360 could end up being considerabley more.......... :eek:

  • have a read here, it seems that you don't let them in, keep the doors locked, but move your car to be on the safe side..

    I know they don't for all other debts, they have to have a Warrant of Execution, then they have to have been into your house, and you signed a Levy of Goods, which they then go back to court with and then have a Walk in Possession Order granted.
    Only then can they break in. The answer is never let them in in the first place...

    Can they take the car?

    I don't know, that's why I'm saying be careful about that...

    Keep in mind that people have other things to do, and you're asking why there haven't been replies in the space of a few mins!

    As I've said in another thread about bailiffs, I used to be a bailiff myself and while that was a long time ago now and my knowledge is a little rusty and probably out of date, I'll do what I can to explain the process and your options as I understand it. My advice is worth everything you're paying for it, if not less.

    A late statutory declaration will at best delay action for a while, it won't make the bailiffs go away, especially as it appears that you don't have valid grounds from what you've said here (e.g. you were notified, don't appear to be disputing anything, just didn't reply to the earlier notices for some reason).

    I'm assuming that if it's northampton county court and bailiffs are involved then its a PCN and there is already a warrant of execution signed.

    Be sure to read everything at http://www.bailiffadviceonline.co.uk/parking_whathappens.htm - I know you've been pointed there already but this is vital.

    If a bailiff attends and you cannot pay the amount in full, including their costs, they will attempt to levy distress on goods sufficient to cover the debt. This means the goods will be seized by them and can be removed, or may be left with you on an arrangement known as a Walking Possession.

    Your mission, then, is to prevent the bailiffs from being able to seize your goods. This doesn't mean shouting at them in the street - they'll have seen that before and won't be impressed.

    What it does mean
    1. If the car is yours (that is, not under finance arrangements, or owned by your partner, say), then they can and will seize it. Don't park it where they can possibly find it.

    2. Don't allow them access to your property. Assuming they have not already seized goods and obtained a walking possession, they have the right to gain 'peaceable entry' to your house to seize goods. This means they can't push past you or kick your door down while you are out, but they can climb a ladder or even get a bunk up off a mate onto your porch to climb into an upstairs window that is already open, for example.

    3. The bailiffs are unlikely to be sympathetic towards any payment arrangement unless they seize goods and let you have those goods back under a walking possession, because they'll want security for the debt to allow an arrangement. Letting someone have an arrangement without security is a rookie bailiff mistake and as much as I'm no longer on 'their side' it would still pain me to see it.

    I am purely curious, what happens if they find that the OP has not got
    enough possessions to cover the debt. ( and hey in all honesty he does because he has a car which he is going to hide.) In saying that we dont actually know if the car would be enough to cover the cost. No ulterior motive for asking like i say, i am curious.
