CSA - enourmous amount of backpay to pay back £98 aweek!

The CMEC legislation sets the " new " agency up as a puppet department.
By separating itself from a government department if it all goes wrong they have a chief executive to blame and deny all culpability.
People should be under no illusion that agency policy ( e.g the 2 year rule ) will be driven by politicians, and the vested interests they have. Which quite frankly does not include the well being of the children in this country.0 -
Same happened to us, hubby had nil assessment and in Jan got letter saying we owed £34,000 but didn't tell us how or why this figure had come about. In a nutshell they took hubby to Court still with no evidence, but apparently they don't neeed it Magistrate has no powers in Court with CSA, bailiffs on hold for 28 days whilst it's investigated internally - but only after solicitor and MP muscle - we're sick with worry - thought CSA was meant to stamp out child poverty try telling that to our 2 children who could soon be homeless for Christmas0

You know what everyone need take a long hard look at themselves here... Just because theres a qualifying child/ren lets not lose sight of the fact children live in NRP household too. ALL CHILDREN SHOULD MATTER. Yes 15 years is unacceptable but so is £400+ per week. Common sense needed herSignature against site rules - FT30

CSA just called me once again to tell me i own then £3000 in back pay i knew id owe it so i dont mind paying it , they want 37 a week out my 199 pay packet (with 3 kids at home , 2 step kids and a non paying dad they refuse to chase ! ) then a extra 20 on top making it 57 a week
she said the good old lie ive learnt on here they all say !
1> we only give you 2 years to pay it back but (after having a silver tongue moved it to 3 years) becuase we know thats impossible we will give you maximum 3 erm isnt that called moving the goalpost
2>we will take your house off you if you dont pay
3>or take it straight out your wages
4>we can send balifs round

lol:D Chill baby, and just hang around here a while longer for someone with the know how to point you in the right direction.
While I do see the short term attraction to your plan above the longer term destruction this would cause you is terrible:p
Keep records of every single action between yourself and the csa and keep calm remember rage is great short term but for the long haul a cool head and a clear mind is whats going to get you the results that will clear this up:)
Our dealings with the csa left us out of pocket and no one really cared or knew what was going on bit of perseverance put it right aka quite a long slog.0 -
Ok lets look at this. CSA state you owe £15,000, are you sure this figure is correct? If there is any doubt in your mind, please write to them asking for an account breakdown, but, of course put this request in writing and send recorded delivery.
If on other hand, you are pretty sure the arrears are owed, then you will have a fight on your hands. It may be worth putting together a letter to them explaining the children/circumstances of your household, and an income/expenditure, doubtful they will negotiate but always worth a go. I would as others have suggested, go to your MP, and state that you are happy to pay arrears, just want to negotiate a more affordable payment plan. I would also make a complaint against CSA, and put it in writing, as when they give you the final 'not interested response' then you can go to ICE.
If you cannot come to an agreement, then they will gain a liability order, CCJ and possible charge on your home, if you fear/suspectl this may happen, you can protect your home, but act1ion must be taken prior to a liability order being issued.0 -
Hi bdt 1 and all...:)
This sounds horrendous...just reading it through..and when I see what happens to everyone and how this affects them I feel SO sad for everyone..:(
I was on the other side in my own case...and never DID get any money back from my ex hubby even though I was with the CSA as a Private Customer for 5+ years as well as being on benefits and with them ( so SHOULD have apparently got something during THAT time, whilst our daughter was still in education..but never did..and have since been told ( I only found that out last year...:( ) by the CSA that it was 'MY fault for not knowing that I was entitled to the arrears, but as the case has now been closed for over 6 years now..it is too late to ask for the money!!!'...
So......my probs/old case aside..reading the above thread...HOW can you protect your home???
Am all ears about this..as you know (bdt1) we are both registered disabled and VERY interested in the outcome of 'what happens' with this kind of scenario.......
PS...For anyone receiving nasty calls from the CSA at all..please see the draft below I recently sent in, as advised by an ex CSA worker..(Fankkkkkoooooo..you know who you are..:))
In future ONLY accept correspondence in writing....
Send this draft ( in your name/ or the person you are working on behalf of) to the Complaints Dept in YOUR area, and make sure that IF they persist in calling again, that you record the call ( most mobile phones WILL record a convo for approx 1 hr)
You MUST however inform them AGAIN at each and every call that you are recording the call .....
To Whom it May Concern....
I wish to make this complaint ( or on behalf of / name) due to various recent telephone conversations from members of the CSA being of an intimidating/threatening nature.
I now request that all further contact regarding my (/ this) case is submitted in writing.
I expect this request to be upheld and accepted as stated within the Human Rights Act in the CSA guide.
I wish to inform you that should you persist in any further calls these will be recorded, and each caller will be informed of this at the time.
Yours faithfully (name & signature)0 -
Hope the above post helps someone at some point..(Forgot to add this...)...:) 0
