E2Save up to no good?

I purchased a phone off E2Save on 21 Dec and it promptly arrived the next day which was all well and good. I have bought off them before and never had probs with cashback so I thougth I'd stick with them.

Anyway, I thought I would wait a few days to activate the sim but in the meantime I received a letter from Orange saying thanks for opting to pay by DD etc. I never authorised Orange or E2Save to do this!

Secondly, E2Save used my landline number on the invoice they sent me which I did not give them this time round because its been disconnected. Seems like they went into my old account to get this info.

Thirdly, I tried to activate the sim but I got a message saying calls are barred. On calling Orange Cust Services they informed me that E2Save/CPW had put a note on my account saying I must pay £150 as a deposit - no-one told me I had to when I ordered online.

What should I do? Is this a breach of data protection? Im quite annoyed at the misuse of data - would have happily ignored it but as they are demanding a bond Im not pleased.

Cant call them until tomorrow due tothe public hols.

    Hello,

    If they already held the information then technically it's not a breach in that they have it, however the Act does state that the data kept must be accurate which in this case it is clearly not.

    As described by the Data commisioners website;

    Correcting inaccurate data
    You have the right to have inaccurate personal data rectified, blocked, erased, or destroyed.

    If you believe you have suffered damage or distress as a result of the processing of inaccurate data you can ask the court to award you compensation.


    If your not happy with the phone then they should operate a returns policy under the distance selling regulations.

  • With the 'all calls are barred' bit, my stepdad got a phone from Orange directly and had that problem. You need to call them to register the phone and from the phone too, which is ok but you can't call until they unlock the phone, erm? Someone needs to check that at Orange. We took it into the shop in the end.

    as far as i know a contract starts from when you take out the contract no when you place the sim in your phone.
