02 - debt

This is a bit long but i'll shorten it. My daughter just before her 18th birthday which was over 3 years ago. Decided that she wanted a mobile on contract. As she was not 18 i signed for it. I had no problem with this and the shop was ok with it. We went to the 02 shop in liverpool and i signed a contract. Which we were happy with. And came out with a mobile and a plan for £19.99 a month on d/d from my bank account. Three days later another mobile arrived from 02. I contacted the shop as we did not know why this had happened. Apparantley when the lad had sent the info to 02 he had pressed it twice. thus resulting in two mobiles in my name with d/d's set up. We travelled back to liverpool to return the 2nd phone and sign papers. I cancelled the d/d for this. And this went well. 4 weeks later we checked the on-line bill and it was for £80. After many calls to a 0870 number and visits to the shop. We found out that we had been put on the wrong tarrif. 02 said that they would not take payment but would sort it out. The didn't next month we owed over £200 as every call and text was being charged. Because we wasn't on the right plan. So i cancelled the d/d. I spent all day in the shop in Liverpool and let them sort it out. I made sure that all calls to 02 were done in front of us. An agreement was made that 02 would take back the phone the contract would be cancelled. No payment would be required as calls could not be worked out. Regarding to the tarriff. Happy with the fact that all was ok. I went ahead and signed a new contract for the same tarrif that i had originally wanted. Everything was ok and we paid £19.99 for the next 12 months. That contract ended Oct 2002. We never renewed with 02 again as my daughter decided to go on a payg. Last month she was 21 and decided to go on a monthly contract again with 02. All is going well.

Today i came home from work and there was a letter from a debt recovery company in Scotland. They have been contacted by 02 for an outstanding ammount of £161. I rang them as i could not understand what this was for. Got no joy of them. So i rang 02 as the girl at the debt agency gave me the mobile number that the debt was against. You would not believe it they said that there is a outstanding balance of £161 for cancelling the contract in Dec 2001 Yes thats right 2001.



That was me today. I have never in the past 3 years had any correspondance from 02. They know this as it's on screen that no letters have been sent out. They want me to go to the shop and get the manager to contact them. Told them that as far as i'm concerned they can go to hell. They can contact the shop. As i'm contacting a solicitor asap. To have had not a letter in 3 years. Can they now send a debt agency to me.

    Debts can be chased for up to 6 years.
