Thanks - I was not looking for an insurance solution - what I want to find out if possible is whether I have grounds to sue his ar*e off in small claims court!
I think the whole issue of non performance of contract in this lucrative sector of business needs looking at because if rental agents can do this with complete immunity against law means that renters have no rights. I feel an email to Watchdog being penned as I type!0 -

I really do feel for you bigtired24 however, I think you need to concentrate on finding alternative accommodation, you have wasted enough time on this agency so far and I suggest you don't waste any more (until later if you wish to)
let us know what you are looking for and where any maybe we can assist you in looking for alternative accommodation, then once that problem is hopefully solved you can then go after Alan if you want to0 -

I have managed to get accommodation, more expensive and in a different resort but it was either that or risk non refundable flights of circa £2000.
Hence my beef.
I have noted your id as we holiday at least 3 times a year in Tenerife.0 -
at least you have got accommodation and your holiday is ok
I do not know if you have a leg to stand on when it comes to getting compensation, I know nothing of the law but if hotels can cancel your rooms without recourse then I would have thought that agencies can also do them same, they have offered you a refund so I don't think you will be able to get anything else out of them other than your money back
maybe you just need to move and enjoy your holiday in the accommodation that is going to be miles better than what you originally booked - keep positive0 -

If the agent is in Tenerife you are going to have a job suing him in the small claims court. If here less of a problem, but it's the initial one you will need to go for, not the new one.
Large holiday companies have clauses in their T&C limiting their liability in the case of them cancelling the holiday. You only get anything significant if it's a really last minute cancellation. You might want to look at some examples and compare them with your situation - it might give your more of a bargaining lever than threats0 -
Bloody hell, give it a rest. Look, the guy offered you a refund or the place at a lower rate, with plenty of notice. ISTBC but airlines can do the same thing as long as they give you 4 weeks notice and you would only be entitled to a refund, so why do you think this is any different.

his alternative did not suit me and his only other alternative was to give me my deposit back and then !!!!!!off.
are you a lettings agent so therefore crapping on clients is ok in your book?
why should I go softly softly? I went to great lengths to confirm this accommodation because his website did not list a 2 bed. I set out below an extract from an email from me clarifying the position.
His answers to my questions are in capitals and bold.
"Thanks for the info - I will be in touch shortly. I have checked your web site to get more info on the apartment - it does not list a 2 bedroomed apartment - is it just not up to date? THERE ARE 14 NOS. APARTMENTS BEING ADDED IN OCTOBER COMPRISING STUDIOS, 1 BEDS AND 2 BEDS. IT WOULD BE A702 ON 7TH FLOOR TOP. Do you have any photographs of the apartment? Are the bedrooms twin bedded or double beds? ALL TWIN BEDS Finally, does it have a safe? ALL APARTMENTS HAVE SAFE BOXES AND LIST ON MY WEBSITE"
Ironically he still has this apartment listed on his website as a 2 bed.
I wont give it a rest because I have been wronged, its cost me extra money and I am not now in my favoured resort.
The attitudes of some posters on here dismays me to be honest. Poor owner/lettings agent - nasty man - how dare he objects to not getting what he was contracted to receive - you should hold your heads in shame.
Now justify you point of view to me!
