If the guy just handed over their details then surely he is liable

He was conned. He didn't hand them over thinking he was going to be conned.

That's what one of my online account's terms are anyway.

Banks do have a legitimate clause to refuse reimbursement where a customer has fallen for a phish:
    http://www.computerweekly.com/blogs/when-it-meets-politics/2008/06/is-your-pc-security-adequate-c.html

Whether or not they enforce their right not to refund is of course up to them.

However, since OP has not returned to this thread I do wonder if it was in fact a wind up.

Its staggering the amount of people that fall for these scams, even after reading all about them being plastered around the internet. Im wondering if I use my old yahoo account and post to 100 people asking for their bank details and passwords\pin numbers, so I can buy myself a boat, just how many will reply with the relevant information.

Ultimately, there is an argument that the banks should do more to stop phishing scams.

Agree with that. Although they would be extremely limited in what they could do. Either take away internet banking altogether (no chance), or increase security - such as having to register your IP address. Finger print recognition technology is quite mature now, and cheap. Can't see why they can't introduce security based around this.

Agreed. They could also take further measures to stop the spoof websites and lobby governments and law enforcement agencies to investigate a little more fully.
  • It does not matter how many times people are told of these scams, they still get through. Would you leave your wallet on a bus, or give your card numbers to a man who had rung up. I suppose some still leave the keys in the car outside the Newsagent in the morning, with the Sat Nav home button rob my house already activated.

I know they are sophisticated, but there are things the PC users can use to stop these things happening.

1 No one is going to ask for your personal information.

2 Get a recognised Virus Firewall (BT option 3 provides one free worth £60 ish a year)

3 Get updates at regular intervals

4 Use at least IE7 or similar these have some added defence such as phishing filters

5 If the above is too difficult, throw the PC in the bin.

Whilst we're on the topic how does phishing affect Nationwide customers? Since they sent those chip and pin things you need to physically have the card in order to use online banking so in theory it's impossible to phish nationwide accounts.
  • barclays have a chip and pin thing too... like a little calculator, you stick your card in it, type in your pin and it gives out a code (diffrent every time) to log in to internet banking... seems to work ok
In the probably unlikely event that I actually post something of use to someone, an ickle vote of thanks would be much appreciated, in fact I might frame it and put it up on the wall next to my cycling proficiency certificate :D
