O2 Phone Delivered But Not To Me

I ordered a phone on monday. They delivered the phone to the wrong address, not to me.
o2 say the phone has been delivered, DHL have got a signiture proving the phone has been delivered at 12.33 according to DHL, and signed for by someone ?
I cant believe O2 have said i should have the phone , and nobodys giving me a refund
i dont know what to do ?
So, i have no phone AND am £120 out of pocket
Can anyone reccomend anything to help me ? Please

Can you request a copy of the signature from DHL? I had a similar incident happen to me with a catalogue company, it was not for a large amount but they had delivered it to the wrong address and I got a copy of the sig and it wasn't even my name! In the end they gave in but it took a few weeks for me to be credited.Mortgage-free wannabe!0

This happened to me about 18 months ago. Someone in our building signed for my phone (which they should not have been allowed to do) and it subsequently disappeared. O2 were good about it though - rang up and complained and they dispatched a new one.Debt Free Nerd #3100

This happend to me with a £250 dvd recorder last month, I was lucky the the lady brought it to my house, god knows what would of happend if she had not been so trustworthy. So I phoned the cat company and ask them to thank her.0

Same thing happened to me with a phone - the phone company took ages to get a copy of the signature from Royal Mail, and when they did i had to fax a copy of mine from a passport or driving license. This proved that i had not signed for the item, and i was sent a replacement.Debt free date: October 2006 :money:0

Thanks, for all your help guys, i just spoke to someone at o2 who was so nice and understanding. He said that the original phone was delivered to the wrong address and it was not my fault
So, they sent out a replacement phone , which i will recieve tomoro hopefully Laughing

same thing happened to me!!!
The advice I got from the consumer board is to go to the place where they have delivered the phone and post a letter explaining that they have your parcel and you want it back, after a reasonable period (one week) send a copy of the letter to O2 and state you have done everything reasonable to get your phone back. If they fail to sort the situation (very unlikly as they are big company) get your local consumer advice office to contact them (http://www.consumerdirect.gov.uk/). When you finally get your phone write a letter to O2 Customer Relations Department, Suite N, Arlington Buisness Park, Millshaw Lane, Leeds, LS11 0NE (or e-mail mark.robinson@02.com he is a Customer relations executive). They wrote back to me claiming that they tried ringing me (Humm I didn't believe them). I Phoned them on 08453300684 and argued for compensation Got £30 (phone was only £29.99) and £20 free top up for being messed around. Points to put across when complaining about this situation - You have given a delivery address they state nothing in there t&c's about alternative address. they have breached your consumer rights in failing to provide goods and services. And O2 in my case tried to make out it was not there fault but DHL's but remind them that you bought the phone from them in good faith, and they were the ones to instruct DHL.£2 Savers Club total 0 - Thank you Mrs lllnorrislll0 -

I returned home last night to find a Royal Mail "Signed For" letter with no signature - not mine, not even someone a mile down the road. What a waste of time.0
