Road Tax / SORN gap question

What happens if a Road Tax disk expired at the end of a particular month and upon expiry the car was positioned offroad in a private driveway until a new tax disk was purchased one month later (but the owner forgot to send in a SORN certificate for the intervening month)? As a SORN can't be backdated retroactively by the car owner, what's the best way to inform the DVLA that the car wasn't used for that month after the expiry, so as not to be penalized?

I did something similar. The car was unused except for 2 MOT appointments. I could not renew at the local post office in the last days of the month, as I had mislaid the vehicle registration document, and the reminder form, either of which would have been ok then, as there is a validation character that is necessary for renewal. I then found the renewal reminder, but the Post Office cannot issue a new disc backdated to the previous month, or with a gap. So I don't quite understand how the disc was issued in the case you mention.

I went to the local office of the DVLA, and paid for 12 months tax and one month's arrears. She checked that no proceedings were being taken against me.

I suggest you phone up the DVLA and discuss it, as you appear to have a one-month gap. They may accept a late SORN declaration or payment of the arrears. I really have no idea which, but suspect the latter is more likely.
