There's no capital punishment :eek: for people in debt, you've done your best to repay, no-one is going to judge you harshly for that here. BR will give you a fresh start, you are doing the right thing!

Please get legal advise on this - contact one of the debt agencies, and explain that these accounts are showing incorrect information - you will need to discuss BR with one of them anyway. Come clean. I know they could be contacted by the OR but I see no point in hiding these discrepancies away. Also, excuse my ignorance, but I can't see what benefit these have been to you, if you are still using your same address. You would still be identified, surely? My sister, for example, uses two names, her married name and the name she chose for herself before she married and is known to for her business and social purposes.
The other thing to consider is to contact all the catalogues and get them to put their records straight. How about doing a standard letter to all your creditors to get them to check their information.
Everything you list on the Statement of Affairs will be part of your bankruptcy. You can add a note to state that such and such account is shown in such and such a name. I doubt whether DOB will even come into it tbh.
Please consider going for a complete explanation with the OR, if these things come out, and I am sure you are not the first, nor last, to do something daft like this, and that's what it is, something daft, give yourself some slack. If BR is the only thing for you, and that sounds like it, then do it, be honest when asked, and please don't drive yourself crazy with all this. Nothing can be as bad as that.

Sorry - posting crossed with other posts saying similar positive things. I don'tknow what LILA is (sorry) but I do know about BR and the OR does seem to be inundated at present, every time I ring the official has to clear his desk and remind himself of my situation.I think it also depends on the amount of debt. If it was hundreds rather than thousands - and I think catalogues tend to be lower amounts - then they are less likely to be concerned.Bankrupt 11th June 2008

Financial Pain - sorry I seem to have got behind with the posts on this thread - there is hope for you, loads of it, Br is a relief, we've all done daft things on here, and it OK. You are allowed to do daft things.
And thinking further about this name problem - I have a surname that is often spelt wrongly, and that makes it another quite common surname. I don't see that it makes any difference, I'm not denying the debts I had.

Thanks for all your support and kind wishes.
Consulted the solicitor earlier.......told her absolutely everything. Solicitor was a drop-in clinic which takes Legal Aid. Solicitors here can be very busy and I am too anxious over my situation to have waited `til possibly next week for an appointment with another solicitor, but........solicitor said she`d have to look into what the OR is likely to investigate.......she said I`ll hear from her in about a week. :eek: Will be petitioning for BR through the L.I.L.A. scheme, IF I decide to proceed with it.
I feel that I don`t have a week to play around with, yet at the same time, I know it would be best to wait and see what her advice is, before I decide what to do for the best.
But, I`m sitting here having kittens, as I have to wait a week for feedback from solicitor. One of my main worries right at this minute is that I`m wondering if my creditors may petition for my BR......is that likely to happen?? Am feeling very much that time is not on my side, just as the circumstances of my situation aren`t either.
I am at a loss just now.

at least you now can get the professional advice about your situation and It must feel a little better to know that someone is doing something positive to help you.
Have you had any court forms through at all? Am afraid I don't really know the ins and outs of when someone makes you bankrupt but maybe it would save you the fees?
Can you maybe get away for a little while to stay with some friends or family and try take your mind off it? Just try and wait for her advice, not easy I know but stay positive and we are thinking of you.

It is very unlikely that they will petition for bankruptcy, it is rarely worth the expense of doing so, and if they did it would save you the fee. It cost them more. The councils have been known to, but there are not many others who do.
In any event you will have more than a week.
If you cannot wait, please phone one of the charities, CCCS or Nationaldebtline for advise. I know they are inundated and you have to keep dialling, but you could discuss with them as well, the numbers are in the initial threads on here.
You do have time on your side. I know it's easy to say, don't worry, and you can't help being stressed, but you have taken a huge step to get yourself sorted by seeing the solicitor and you are on your way.

Pleased you have got the ball rolling with some expert assistance.
As for making you a bankrupt generally speaking it's not worth their while as the cost to them is prohibitive. They would rather go for CCJ's etc or just bully you which is even cheaper.
In the mean time you could write to your creditors and inform them that you are seeking advice due to your cuurent inability to service your debt (no more explanation than that) Give them the name of the solicitor you are consulting, tell them you are also seeking debt counselling (we'll back you up on that one) and you hope to be in a position to write to them soon with further information as soon as you are better appraised of your position. Tell them not to phone as you are under enough stress and considering (or actually...nudge nudge) seeing the doctor for depression/anxiety etc.
Send them all by recorded (signed for) delivery and that will take the pressure off.
It may also help at a later date if you can say you had written to all your creditors informing them of your situation.
I did this several times during the long lead up to my IVA (took 5 months to set up) and again 6 months later in the lead up to my BR (about 3 months) It definitely took the pressure off, and prevented any court action (apart from the council as I forgot to write to them)
It makes you feel better while you waiting too.
