    i think you will find this is called fraud, i carnt offer any advice apart from this could get you in trouble, the only thing i would say is pay them off 1st then there will be no issue

    Hi FP,

    re the one with the name, you can pass that off probably as an admin error, I am sure it happens lots when people take out loans and things and the name is not always quite correct. just that you never got around to asking them to correct the name, it didn't seem terribly important.

    The date of birth one I don't know about, it is a bit more risky to try and explain it.

    I know what it is like to be a bit desperate and I can understand in some way why you did it. I can't tell you what the OR will say but if you can, I would recommend try and pay off the one with the wrong dob at least if you can find out which one it is. And then like cassy said, it won't be an issue then.

    Try not to get yourself too stressed, the important thing is you have acknowledged your mistakes and you are trying to sort things out now.

    oh and if you want to check which one has which date of birth, maybe you could try asking for a copy of the original application for each of them so that you can check it?

    is there any other ways you could cut back or increase your income for a while to give you time to sort them out before going BR

    btw you can do your own DMP even if you pay them £1per month just send letters to them your self... it could get them off your back until your situation improves

    have you posted your income and expenditure in the debt free section
    has others commented? any suggestions??
    any friends or family to help?

    if you havent pls ask in there for help they are very helpful

    i havent gone BR myself as i dont want to go down that avenue so i dont know all the legal aspects but i would only consider as a last resort if you know your situation will not improve

  • Hi FP, I'm not a legal expert so someone with more experience may contradict what I am about to say - but here goes!

    Some years ago someone used a variation of my name to obtain credit at one of my previous addresses. I only found out about it when a DCA came after me for about £360 outstanding on a catalogue account I didn't have!. Anyway, I contacted the police for advice and was told that anyone can call themselves any name they like and it's not fraud. It's only fraud if you take out credit with no intention of repaying. As you have ben repaying these accounts then that does not apply to you.

    The only issue I can see is you "misled" the companies into possibly giving you credit when they might not have if they had your correct details. If they did their job properly and ran a thorough credit check they would know you had provided slightly different details - as I see it, it only shows how lax some of these companies are!

    Good luck with the LILA, here's hoping the LILA option is available to the south of Hadrian's wall soon!:o
