need advice on benefits and car if going bankrupt please

im currently in about £5,800 debt with 2 credit cards and overdraft mostly due to my ex but he wont pay towards the debt and the cards are in my name.
i have a telephone appointment with the cccs next week they have talked about bankrupsy but will talk about it more on the interview.
i have a car its in my name but it aint at my address as my dad didnt know my post code and havent got round to changing the address yet and the insurance gets took out of my mums account as my bank wont let me have dd its a cash card from nationwide the insurance is £40 a month.
my dad bought me it as an early christmas present as i have 2 kids and take both my nans shopping he only paid £300 for it but its a r reg will they make me sell it? as my nan has heart troubles due to heart attachs and anginar and my other nan has suffered a series of strokes so cant get out and about really for to long but still like to browse the supermarkets so rely on me taking them shopping. i live solely on benefits so would like advice from someone in the same situation on roughly how much ill have to pay each month towards my creditors for the bankrupsy

If your dad bought it and he can prove that then it is not yours, end off
If he can not find any recieipt, evidence via bank payments, he can swear it is his property, but that complicates the issue
See if he can find evidence of the transaction, if he can the OR cant touch it

my dad hasnt got the reciept of the car as he got it off ebay and they ended the auction early.
so what shall i do? the car is in my name but not my address and the insurance comes out my mums account but my dad pays it as i take my nan shopping he pays the tax and mot all i pay is petrol. shall i say anything or not about the car?? as its not registered at my address? the only thing that has my name and address about the car is my insurance but anyone can have insurance on a car doesnt mean you own it.
my dad doesnt mind if he has to come to court and say it hes car but as blind as a bat said it might complicate matters

I think it's probably best to tell the OR about the car but explain fully that it's your dad's and what you use it for (but that's only my opinion!;)). I'm not sure they'd take a car worth only £300, as they'd get hardly anything for it at auction (and in the current financial crisis!) It's a difficult one - some on here have been allowed to keep the car, others haven't. Seems to depend on the OR - but I definitely think it's worth a try! Whether he'd allow the expenses on the SOA is another matter of course.
It sounds like you'd be happier declaring it than keeping it "hid" and feeling anxious about it - sorry if I'm wrong or that sounds condescending, it's not meant to be. It seems from what others have said, and my own experience, that the less you have to worry or feel anxious about in BR, the better!

If the car was bought on ebay can he not email the seller asking for receipt? Does he have any email communication with the seller? if so, ask him to print it out and also maybe he could email seller asking for receipt. Did he pay cash? IF so is there a transaction coming out of his bank? (A lot of 'ifs' here!, if there is a bank transaction showing he took out that amount of cash and it ties in with the email communication from seller or anything else on ebay that may prove receipt enough!

yeah i think your right its just my last car was a complete banger the cluch was nearly gone the handbrake didnt work and the suspension squeeked like hell you could hear me coming a mile off also had to kick the !!!! out of it for the first 10mins of driving to be able top get it out of first gear( thats not why the clutch went by the way lol)
so if id still be driving that i wouldnt have cared if they took it as they would have got more for scrap( i checked), but i love this car it actuly does was its meant to and coming from the banger its like driving heaven

I really hope they don't take it from you, Lisa! As FYP says, if your dad can get some proof that he bought it then they can't. I also think that taking your nans shopping should be allowed as a reason to keep it, if that's the only way they can get out regularly. Lots of Govt depts ask you whether you have children and/or elderly dependents, and make allowances for that, so I don't see why the OR should be any different. That's just my opinion, tho, so not necessarily what actually happens:rolleyes:!! Good luck! CBx:D0

I would still try and prove the car is owned by your dad. I think there is also a space on the br forms asking about dependants. Although ypur Gran isn't youe dependant, you sre still taking some responsibility for her care by taking her to do her shopping - worth a try!
