Ebuyer - returned item to the wrong address!

  • ....Got a response to my letter...

They are now saying that it was signed for at the billing address - WRONG -and that it was signed for IN MY NAME and because of this they are not pursuing the matter and I need to contact the local authorities.

So the flat-out lying has continued - that address has never been in my billing address, the person who signed for it was a Mr Coullan - BECAUSE EBUYER TOLD ME THIS EVERYTIME I RANG THEM UP. And they're not contacting the police now (like they said they would) - its for me to do.

This is absolutely ridiculous, they're constantly changing the information. The police can't do anything because they need the signature proof from the couriers which only ebuyer can provide - I wrote all this in the bloody letter!

So I'm going to ring consumer advice back when I find my reference number....will consumer advice just write ebuyer a letter?

Ask for a copy of the signature.
If it doesn't match yours then its fraud.
Did you pay originally by credit card , maybe they can help.

    Here's my tuppence worth.

The TV was returned to the wrong address. However, it was addressed to you! It's still your property as it would clearly mark so on the box. If Mr Coullan has taken the TV, opened it, is trying to keep it, it's theft.

I suggest you knock on his door, ask for Mr Coullan, if you get a positive response you've confirmed a Mr Coullan lives there and has signed for your TV. Then tell him why you're there. Your tv should bve sat in its box unopened.

If i were you. I would save all the hassle of dealing with Ebuyer and getting yourself worked up. You're assuming the worst if you go and knock.

What will most likely happen is that he say "Yes i have it, here you go".

You've got nothing to lose and you could end all this hassle now.

No it might not be the principle, but you need to take a practical approach to end this and save yourself alot of grief.

d.edna, Iain_B gave a detailed set of suggestions so why not just read them instead of just throwing his perfectly reasonable argument back in his face. He even suggested seeking legal advice, and your initial response was to
go on about all the 'armchair lawyers' in here, even though neither Iain nor anyone else in the thread had claimed to be a legal expert.

I find it difficult to believe you can be this disingenuous without knowing it, and am sure you must be deliberately trying to wind people up. Unfortunately, you're not very good at it, as your debating technique swiftly descends to playground level and lower, and you start accusing people of being trolls, when confronted with intelligent opposition.

As for your advice to contact the police, he has already explained why that was not feasible at present:

The police can't do anything because they need the signature proof from the couriers which only ebuyer can provide - I wrote all this in the bloody letter!

Gotta love the all the armchair lawers on here

Is that not what the forum is about, helping others with consumer issues ?

  • I've went round twice now, no answer. I doubt my TV is still in a box in their kitchen now, especially as they refused to give it to the courier.

They won't supply a signature to me, as I asked for it in the letter. They originally said they would supply the police with the information, but obviously this has all changed now as they've told me to 'contact the authorities'. When I rang the police originally, they said they needed this signautre proof otherwise they couldn't do anything. The police were helpful, but said it was more a consumer direct issue.

I don't even know what the signature is anymore - everytime I rang them they said Mr Coullan, but now apparantely its my signature?

I'm not even going to bother replying to ebuyer agan as its not worth the hassle and they can't keep track of what they've been telling me.

I'm going to ring consumer direct tonight and see what they can do.
  • You may have to take ebuyer to a small claims court because it was their mistake. I would imagine that it should up to them to get the tv back from Mr C. Anyway the tv is probably getting used and why would the op want it back especially after being in a student house.

Not a good idea in my opinion. eBuyer arranged the couriers - it's THEIR problem.

That may have been the case - but surely now it's fraud and theft ??

    I would also try CAB.

Good luck and keep us posted...
