Use the 'report this message to ebay' option in the small print under the message where they are refusing to sell, open a non performing seller dispute and leave a negative.

Small claims court fee is automatically claimed back from the other party if you win.

The yacht case was in Germany, so has no bearing in this country. Ebay is not classed as an auction house in the eyes of the Law over here, thus bids are not binding and no-one can be forced to go ahead with a transaction. The only action that can realistically be taken is for Ebay to kick persistent offenders off their site. No financial penalties can be imposed.
