Don't sign the letter - just print your name and send it recorded delivery otherwise they will deny they've received it.

I echo this by Deep In Debt - send it recorded delivery so there is proof they have received it, and NEVER sign your name to them, as some of these delightful companies are not above forging signatures to create fake 'original' documents. Likewise, never send them ANY ID documentation (sometimes they will ask for a copy of your driving license to 'prove' the signature they have is yours or similar).Deep_In_Debt wrote: »Hi

I too think you should get a better solicitor - can't hurt to at least have a chat with a different one...
Incidentally, has your wife ever made financial contributions to the mortgage? If you can prove that she didn't (e.g. payments have always been made fron an account soley in your name, not a joint account, and she has never paid money into that account) it might help. Only speculating though...
Yes, pushing the credit card thing will get her into trouble, but as you say she didn't seem to mind getting you into it, and you really shouldn't have to be paying a debt which was fraudulently foisted on you. I don't like getting people into trouble either, but regrettably in this case I'd say an exception is well deserved!

You do not need to send the letter recorded delivery, you must send it registered delivery at least - which is cheaper.
If you have any joint accounts against which you ex can take out money, contact the bank and make sure that all debits required both signatures.
And yes, it has been known for CCAs to be returned with forged signatures.If you've have not made a mistake, you've made nothing0 -
Hi - it is still ongoing but I have a question if you dont mind -
What would happen if i defaulted on the marital home and my flat, which has a secured loan on it?
I know the BS would sell them for what they can get, but what about the shortfall (which there will be) - how do i repay that back to them?
Giving the keys back would be easy for the flat, as they are in my possession, but a bit harder for the marital home as she has them and she says there is no way im getting a set!

I really think you need to get legal/expert advise on this as its a complex area but I would assume that if you default then you would be penalised but discuss with your solicitor or a co like cccs ....its hard to say without fell details and personally I feel some things are best not said on the boards - you never know who is reading!!Nerd no 109 Long haulers supporters DFW #1! Hang on... so your estranged wife lives in YOUR house, that YOU pay the mortgage on, with some other bloke's kids, and says YOU can't have a set of keys? And your solicitor is being useless but you're still paying her? And you're servicing a debt that your ex ran up fraudulently?
Dude, forgive my bluntness but it's time to grow a pair of rocks. Sack your solicitor. Find one who will know what to do to get this bird the F**K out of your house.
