And would you like to live in the same building as this SCUM?

Would you not be worried about break ins when you were at work?

After paying to buy a nice property the LL then puts in a SS tenant, who then makes your life a misery, no wonder the OP is worried.

The tenant will end up destroying the place, and bringing the house value down.

Thanks and well said... i was pretty mad after seeing premier's response.

    Slightly off topic but -
We owned and lived in a block of flats (12) in North London N20 in the early 90's. The terms of the lease did NOT ALLOW owners to rent out their property. Each owner had one share in the company that owned the leasehold. This meant nice peaceful living as there were no rapid changes of tenants and as each owner lived there everyone cared about the property.
This is probably very unusual in these days of buy to let. In an owner occupier situation it is a great advantage.
Could this be the long term solution to your problem. Good Luck

Well it's funny you should say this. Our lease actually says something very vague i.e. flats cannot be used for any trade or profession.

Could you call making money from rent a trade? We put it to our solicitor about 6 months ago and he said, as it doesn't specifically say 'you cannot sub-let any of the flats' that there wasn't anything we could do.

can you remember how precise the wording was in your lease??

Does anyone happen to know what percentage of votes we'd need to add a new clause to the lease and whether a clause can be added now even though a few of the flats are already rented??

Presure needs to be put on the owner of the flat. If you can put a figure on any damage done by these tenant get a really expensive trademans to quote to put it right and bill the L/L . Send all letters twice one by reg post and one by normall and when he doesnt pay put in a online moneyclaim. If you win or not it doesnt matter but he will soon think the tenants are more trouble than they are worth.

    Hello again Greenr,
Sorry have forgotten completely the wording in the lease. I certainly think letting a flat for money is trade. Perhaps more research is needed but a buy to let mortgage is surely a business loan!!!
    Good Luck.

Does anyone know how many votes (as a percentage) we would need to add a new clause to the lease stopping any future buy to lets in our block of flats?? We're in the process of extended the lease so this would be a perfect time to add something!!

My Chief Constable has been given targets to reduce anti social behaviour.

Phone your police non emergency number to report anti social behaviour and make sure that you get a log number and keep a diary of events.
  • We have just come out of the end of a nightmare situation with a tenant renting our flat in a brand new luxury end development. They started off well, be-suited and professional, but over a period of 6 months slipped into non payment of rent, lost their job and got mixed up with very dubious characters. We had to issue an eviction notice via solicitors, but then matters were taken out of our hands when the other tenant had to call the police at the weekend. The tenant cannot now approach the property or tenants, so we feel a bit safer with this knowledge and can move on from it. I strongly recommend calling the police, and perhaps a note to all tenants and owners saying that the management company will do this each time an incident happens might get the owner a bit concerned. Also, what if they are damaging the owners property - surely they would be concerned about this themselves? You should point this out to them. I do feel for you as it is a nightmare situation to be in and a very frightening one too. But use the power of the law on your side at all times rather than taking matters into your own hands. GOod luck!
Feel free to thank me, it makes my toes tingle and my ears go warm :T
